@design_law The patent is assigned to Magic Leap and it looks like they make augmented reality devices. I'm not sure why they chose to use "mixed reality" here.

@blogdiva I'm not sure since I'm not familiar with those, but this patent is claiming the design of the room.

meredithlowry,
@meredithlowry@mastodon.social avatar

@blogdiva Ah. Invalidating is potentially correct for a design patent, but it is rare. My mother sewed, so I remember the file cabinets of sewing patterns, but I never paid attention to their protection. Now, more of the patterns rely upon copyright and claims that home sewists cannot use the pattern for commercial products.

The plaintiff in this recently-filed case says "there is no question that an ordinary observer would view the patented design and the design of the Accused Product to be substantially the same."

I have questions.

@design_law The plaintiff needs to avoid the beach. There are tons of shades like this out here and none of these are that design.

@design_law I'm going back to the beach now and ignoring the hearing. But I love the running commentary from your perspective.

Okay, I'm going to try to listen in on this hearing: https://judiciary.house.gov/committee-activity/hearings/there-right-repair

We'll see how long I last.

@design_law Ahh. I feel like I would have screamed through most of this hearing. 😬

@design_law That was exactly my thought. I don't normally include the assignee in posts, but this one seemed relevant.

Today in design patents, display screen edition:

D991960 issued for a display screen or portion thereof with graphical user interface.

This one comes with a delightful copyright reservation notice in the description, which is allowed under design patent examination rules, but is questionable in application here.

@design_law I had to stop looking at the GUI patents today. There are too many bad ones.
