Apparently it's the former. Their prosecution rate is 8% apparently according to Wikipedia, because they're too understaffed to deal with cases that can go either way. They also have a false confession problem, but that's not what's getting them to that rate.

This logic only works if you follow the Israeli premise that this whole thing started on October 7th. Israel has no justification to "defend itself" from the victim of its Apartheid regime any more than the British had the right to "defend themselves" from the Irish during the Troubles. Which is to say, "self defense" and Apartheid don't go together.
