House representatives introduce law to ban outside adult entertainment establishments

House Bill 245 prohibits "adult cabaret performances in locations other than adult cabarets," and adds to the definition of adult cabaret performances "performers or entertainers who exhibit a gender identity that is different from the performer's or entertainer's gender assigned at birth.

Penalty ranges from misdemeanor to 5th degree felony

@paul, does the law distinguish between drag and other entertainments in which men dress as women? Pantomime, for example?

Is it going to be illegal for single sex schools to cast girls in the role of boy characters? If so, will it be OK to regender all the characters. So both Romeo and Juliet are girls?

I'm seriously wondering how they will make this work. If I were a parent having this imposed on my kids, I would be furious.

The obscenity law is vague, ranging from something that shows lust like a kiss or a character having a crush to intercourse

Shows like Hairspray, Matilda and Mrs. Doubtfire could lead actors & performers to be charged with up to 18 months imprisonment and thousands of dollars in fines

The end sentence means whether it is for pay or not. That's the way it is written. Crueler in print

People found guilty of performing in the presence of someone under 18 would get a misdemeanor of the first degree.

If the performance involved is "obscene", a violation is a felony of the fifth degree. However, the proposed law, as written, makes all drag performing obscene under the proposed law.

If someone present at the drag performance is under 13 years old, the performer would get a felony of the fourth degree under the proposed law.

    @1dalm @paul The son of my high school girlfriend is a drag performer and political activist in Austin. It’s interesting to hear from their point of view. It’s weird that the targets of the culture wars keep on shifting. I mean, drag has been a thing forever. Didn’t hear conservative outcry over French drag shows over the last century. Why now? Must be tied to the transgender issue.

    Even their beloved Archie Bunker in All in the Family embraced drag and Beverly Lasalle, esp when her and Mike were attacked because she was in drag and she later died in the episode "Edith's Crisis of Faith'
