💡 Had the pleasure of sharing the stage in Brussels yesterday with some distinguished experts (Egelyn Braun, Estelle Hary, Silvia De Conca, Tasos Stampelos), preceeded by member of European Parliament Kim van Sparrentak, discussing harmful design.

❗ My points were along the lines of:
▶ Increased power and information asymmetries put consumers at an unprecedented disadvantage, which is reinforced by dark patterns / deceptive design, addictive design and artificial intelligence.

2/ ▶ This makes all consumers vulnerable in certain contexts. Vulnerabilities can be identified and reinforced by increased data collection, in combination with harmful design and surveillance-based advertising. Harm will probably be reinforced against groups who are already vulnerable.

3/ ▶ We need updated definitions of harm, to protect consumers better from undue influence on non-monetary decision making, such as time spent and data sharing. Certain practices can and should be banned, such as certain types of dark patterns. However, we also need an updated framework that reverses the burden of proof and requires fairness by design.

💃 🕺YES!!!!! and finally! The Norwegian Privacy Appeals Board has turned down Grindr's appeal! This means Grindr has to pay the NOK 65 million fine, based on our complaint and report, unless they file another appeal in the court system.

⛔ Just out: The Oslo District Court has sided with the Norwegian Data Protection Authority, upholding the daily fines against Meta for its use of surveillance-based advertising.

This is an important victory for consumer privacy.

⚖ Although Meta is likely to appeal the decision, this sends a strong signal that it is not acceptable to subject consumers to commercial surveillance in order to target ads.
