📣Today, EDRi & @accessnow published recommendations on how the @EU_Commission's #GDPR Procedural proposal can be improved.
To ensure GDPR enforcement is done right, we need clear rules, deadlines, transparency, accountability & rights for parties.
🚨It's urgent to enhance legal certainty & prevent actions undermining GDPR enforcement effectiveness & trust. People must regain control over their data.
The rule would require cloud service providers to collect & retain sensitive data about foreign users, including email, phone number, & payment info. This raises privacy concerns & may conflict with #GDPR.
Another data broker is telling me that they have a „legitimate interest“ in scraping and selling my data because they need to for their business. 🙄 That is not enough.
When someone claims legitimate interest, they have to show that your rights and freedoms do not outweigh their interests. „We want to because money!“ does not quite do that!
Idk why not at this point. The #BridgyFed critics got like everything they wanted. Everything is pretty much #optin. And because of that it's difficult to follow from here the artists I follow at #Bluesky. :satsuki_sadge:
You could say "just ask each one of them to follow you then", but that's easy for you to say. I don't like looking like an unsolicited jerk asking if they want to hear the words of Jesus Christ or something. Which is how I see some of you here on fedi btw. Damn evangelists. No different from techbros or FOSSbros
Now I do think the early stages should be opt-in like a beta as it is right now to iron out the bugs (and there are plenty) before being available fully to the public. But I have a feeling this is never gonna go #optout as it should've been because of the harshness of those ignorant IANALs who do not really understand the #GDPR and other #privacy laws... :reisensweat:

Ci sono plugin per #wordpress davvero gratuiti per la "cookies compilance"?
Dopo 1000 visite dicono che non basta più la versione base, e vogliono che passi alla versione Pro a pagamento. #GDPR
There was a time I was not happy about #GDPR but by now I consider those who made this law to be visionaries: #ChatGPT provides false information about people, and #OpenAI can’t correct it
#openAI « refused to correct or delete wrong answers, and won't disclose any information about the data processed, its sources or recipients. »
"If a system cannot produce accurate and transparent results, it cannot be used to generate data about individuals. The technology has to follow the legal requirements, not the other way around" #chatgpt#gdpr@lamdba
By the #EU's own data sharing standards the #EuropeanParliament has decided citizens' most sensitive data - #health records - can be shared without consent.
Opt-out is not consent according to the #GDPR which means the EU having started well is sliding under the bus of corporate power just like everywhere else.
Somebody has filed a #GDPR complaint about #OpenAI, because they are unable to correct false personal data that is produced by #ChatGPT.
This should be interesting to watch.
#EU#AI#GenerativeAI#GDPR#OpenAI#ChatGPT: "In the EU, the GDPR requires that information about individuals is accurate and that they have full access to the information stored, as well as information about the source. Surprisingly, however, OpenAI openly admits that it is unable to correct incorrect information on ChatGPT. Furthermore, the company cannot say where the data comes from or what data ChatGPT stores about individual people. The company is well aware of this problem, but doesn’t seem to care. Instead, OpenAI simply argues that “factual accuracy in large language models remains an area of active research”. Therefore, noyb today filed a complaint against OpenAI with the Austrian DPA."
The Immigration Exemption aims to let the UK Home Office and companies refuse requests for personal data because it might 'prejudice the maintenance of effective immigration control'.
We've fought against this exceptionalism in data protection, but the Data Protection and Digital Information Bill could undo it all.
🗣️ @sarahalsherif ORG Programme Manager for Migrant Digital Justice.
We challenged the Immigration Exemption with @the3million as it prevents migrants from challenging mistakes in data and #immigration decisions.
The UK Court of Appeal found it unlawful due to insufficient safeguards and considerations of the risk to migrants' rights.
The government has now complied with the Court Order BUT in a way that makes it as difficult as possible for migrants to uphold their data rights in practice.
GDPR PRRR!
The #bigtech companies have masterfully muddled the definitions of advertisement and #tracking, making them indistinguishable for a typical person. I see the #Facebook#privacy tax being compared to the #Youtube Premium all the time, so let me explain the difference and why one of them is unlawful in the eyes of #GDPR.
UK Competition and Markets Authority asked Google to delay the phaseout of third-party cookies to early 2025, the soonest. This new report considers also data protection! Finally!
Some ad industry market participants argue that Privacy Sandbox goes beyond what is needed by legal requirements when it comes to data protection. They would prefer weaker stuff. Would you believe that? #GDPR
Now, from May 18, 2024, we, European citizens, are left with no public access to European institutions, since all their communications will go through US-based private companies that the #EU fined repeatedly for breaking the European Law.
What kind of political power is that? Submitting #GDPR protected citizens to the global surveillance of NSA through USA's "National Security Exception to GDPR"?
