Not knowing US constitutional law, it seems to me the SCOTUS decision might mean that the Dems missed an opportunity when they had the house

That it’s a federal matter seems legally predictable/natural to me, and that it then falls to congress to enforce then also seems natural.

What am I missing on that?

Otherwise, what would the Dems have had to lose by passing an act when they had the house? The 14th was right there.

It's natural that disqualification under 14A should be a federal question, but it's nonsensical that SCOTUS would require Congress to enforce the Constitution. That was not predictable.

What the Dems did do when they had the House was impeach Trump for insurrection. If the Senate had done their job by convicting him, then, in the second phase of impeachment, he would have been barred for office for life. But, led by McConnell, they voted to let him be president again.

Not at all. The rest of the 14th Amendment is all self-executing. E.g. if your right to due process has been violated, you can sue, without needing Congress to pass a law that specifically protects you. As the 4-justice SCOTUS minority said, it doesn't make sense to require legislation for just this one section.

Anyway, if the Dem-controlled House had passed a bill declaring Trump ineligible for office, Senate Republicans would have filibustered it. So it's a moot point.

    I'm not sure I understand the speculation about the Colorado decision coming tomorrow.

    Pending SCOTUS' ruling, Trump remains on the Colorado ballot. It seems basically certain that SCOTUS will rule, probably unanimously, that he can remain on the ballot. So why would they feel pressured to issue the ruling before Super Tuesday? Would it be basically to prevent confusion, and reassure CO Republican primary voters that their votes will be counted?

    The Washington Post does a weekly summary of where the Trump trials are. So far, I have no complaints. The law is presented in a straightforward way, it's accurate, without the breathless hype.

    What would you make of SCOTUS' denying Jack Smith's petition to consider the immunity theory back in December, only to accept Trump's petition now?

    This article cites a law professor who says "the Supreme Court had agreed to fast-track appeals in 19 other cases over the past four years." Is there a legitimate reason (i.e. other than deliberate delay) for wanting the DC Circuit to rule first in this case?

    Trump said in Richmond, that he will take all federal funds away from public schools that require vaccines. Like most states, Virginia requires MMR vaccine, chickenpox vaccine, polio, etc.

    So Trump would take millions in federal funds away from all Virginia public schools.

    That's an excellent point. Especially because we already know, in advance, that the courts will be ineffective in bringing a judgment.

    No matter what happens with any of Trump's trials, there is zero chance that any of them will prevent him from becoming president. We the voters have to do that, and we already know what we need to know about him.

    Thank you for posting this. It's very educational for people like me who want to understand Israeli politics better.

    Barak writes "Eisenkot, Gantz, and Lapid should... demand general elections..." As a practical matter, who can actually cause elections to occur? I think it has to be the Knesset? I'm a bit confused regarding why any government would choose to hold elections that might remove it from power. Other than for the good of the country, of course, which is not on Bibi's agenda.

    If we had only just been willing to get off our couches and vote, just one time, in 2016, we'd now have the first majority Dem-appointed SCOTUS since 1969.

    Roe would be intact. Citizens United would probably be overturned by now. The whole future of humanity would be different.

    I think even "hiring someone for a job" dangerously misrepresents the decision.

    If you're on a hiring committee, and you don't like either of the two candidates you interviewed, then you can just leave the job open for a while and interview some other people.

    Elections don't work like that. There are two possible outcomes, and we are all going to have to live with the one that we get. Anyone who prefers one outcome to the other must vote for that outcome.

    I see folks saying they are confident that ultimately this Supreme Court will reject Trump’s claim that presidents have absolute immunity from criminal prosecution for official acts. I’m not. I meant it every time I have said that Trump appointed Justices Gorsuch, Kavanaugh, and Coney Barrett are almost certainly in the tank for him. Were they not, they’d be recusing themselves from all his appeals, as their participation certainly has, at the least, the appearance of impropriety. 1/

    For what it's worth (which is very little), current state polls put Trump's likelihood of winning near 100%. And nearly every possible political force is currently moving in Trump's favor.

    The Republican justices know why they were put there and have delivered for their party once again. Not sure why anyone really expects them to be non-political at this point.

    My mistake, I meant to say "if DOJ had indicted Trump for obstruction back in 2021, as Mueller intended" (not 2017).

    Trump fired Comey to obstruct the Russia investigation in 2017. Mueller investigated him, but of course Trump couldn't be prosecuted until 2021.

    The statute of limitations for obstruction is 5 years.
