I do understand that the ai doesn't understand the data they input or output. But when put in those terms its harder, for me and presumably others, to see a clear distinction.

A writer takes old ideas, remixes them. An ai takes data and remixes it.

If the author's published story is too similar they may face legal action. If an ai's output is published and it's too similar then legal action makes sense.
