Legal question: If a private college calls out cops to get rid of protesters and the major intervenes and tells the cops to stand down, would the school have a cause of action against the city if something happens?

@BlackAzizAnansi Cops don't have a duty to intervene.

@tilde That's a different situation, a private institution still has a duty to motivate damages and the question is if a municipality could be held liable if they were found to have interfered with that.

@Karstan That's a bit different imo

@BlackAzizAnansi yeah, but you'd have to have a cause of action to sue the police. Generally suits against police involve 42 USC §1983 which allows you to sue cops for a violation of a constitutional right (if memory serves, it's been more than a decade since I practiced law). Otherwise most cop behavior/action is protected by "qualified immunity" against civil suits.

@BlackAzizAnansi oh dang, but you're saying maybe a suit against the mayor? I think qualified immunity still applies here, but I could be mistaken.

@Karstan Against the city as an entity.
