No shit it got violent police reprisals. The students are just easy targets because they know that if they actually pick useful targets, they will get a police response. This entire thing is a show at the students’ expense.

No, they don’t deserve any respect for this. They are cowards, just like all the people that lost morale and broke when we were kettled at the BLM protest I attended in 2020. Nothing meaningful will come of this. They should have held out until meaningful action had already been achieved instead of agreeing to some dog and pony show in October with no amnesty for the protesters.
So if you make up some BS and try to pedal it as fact, it is not protected speech. That doesn’t make your lies facts, nor does it make them opinions. They’re just lies.
EDIT: Before anyone tries to bring up lies being spread in other contexts, this is specifically in the context of defamation, and defamation is an established exception to what constitutes “free speech” under the First Amendment.
Why wouldn’t it be? It’s just as much a textual medium as a PDF, or a book, for that matter. Hell, any file on a computer can be read as characters. I could type Homer’s Odyssey in a series of comments, or the source code to DOOM, or the color values of every pixel of every frame of a video I took of my friend chasing a duck.
As long as you aren’t committing copyright infringement by using a meme you don’t have the rights to, and otherwise meeting the standards of having a “modicum of creativity,” I don’t see why you wouldn’t have copyright on it. That being said, there are few goals more futile than that of trying to remove something off the internet for copyright infringement.
