Nintendo went after them for using (not distributing) prod.keys to decrypt game titles and system firmware under 17 U.S.C. 1201 (2), which sidesteps having to challenge the legality of emulation directly. I guess Yuzu doesn’t have the funds to fight them in court on that.

It’s illegal to distribute tools to circumvent DRM.
It’s a massive reach, but it’s a plausible argument—or even a good one if the judge is a technologically illiterate luddite. Beyond that, Nintendo is the kind of litigant that will drag out a lawsuit until the other party is forced to settle.
Obligatory fuck Nintendo, but don’t make too much light out of this lawsuit. They’re aren’t attacking the legality of emulation itself (which has a ton of precedent defending it) but are instead trying to convince a judge that Yuzu is a DRM circumvention tool.
If they land a technologically-inept judge that believes decryption itself constitutes circumvention regardless of how it’s used in the bigger picture, there’s a decent chance the argument might have some teeth. Or, because there’s no precedent for this, the lawsuit will drag on until Yuzu runs out of money and is forced to settle.
If it’s within your financial means, please donate to Yuzu. If they lose this lawsuit, the precedent it sets will open up other emulators that work with encrypted ROMs (e.g. Dolphin and Ryujinx) to similar lawsuits.
I’m pretty impressed with The Verge this time around.
They did a very good job quickly explaining the legal stance and argument that Nintendo has with their lawsuit, what needs to happen for it to be successful, and how the precedent set in 1999 around emulators isn’t applicable to this suit.
Epic has spent the last few years campaigning to sway public opinion of Steam. Their whole campaign relies on making Steam seem like a monopolistic cesspool of shovelware and garbage, and they need to present themselves as having the moral high ground to do that. Never mind that NFTs are more predatory than at-your-own-discretion purchasable pornography.
