@NorCalWineLady Thank you.

2/ Judge says he's been under the weather.

Says neither Wade nor Bradley established that atty/client privilege applied.

GottaLaff,
@GottaLaff@mastodon.social avatar

4/ Bower:

Judge McAfee kicks off w/ a summary of why we're here:

After meeting w/ Bradley in private, I found that neither Wade nor Bradley carried their burden of establishing that attorney-client privilege applied wrt whether there was a relationship btween Willis and Wade.

GottaLaff,
@GottaLaff@mastodon.social avatar

5/ My numbering got messed up, but pick it up here.

Bower:

Merchant, for Mike Roman, starts us off, asking Bradley about the timing of the relationship between Willis and Wade.

He says he has no knowledge of when the relationship began.

GottaLaff,
@GottaLaff@mastodon.social avatar

6/ Bower:

Merchant: Do you think the relationship between Willis and Wade started before she hired him?

Abbate objects; overruled. Merchant shows the state an exhibit of text messages that she intends to show Bradley.

GottaLaff,
@GottaLaff@mastodon.social avatar

7/ Bower:

(If you recall, Merchant is the squeaky-voiced blonde Trumpy who is beyond annoying)

Merchant: Do you remember telling me via text that you told me the relationship started when Willis was a judge in South Fulton?

Bradley: I see the text but don't recall sending the message.

GottaLaff,
@GottaLaff@mastodon.social avatar

8/
Merchant: Do you remember telling me "absolutely" when I asked if the relationship began before Willis hired Wade?

Abbate, for the state, objects, arguing that Merchant hasn't established how Bradley might know about the timing of the relationship.

GottaLaff,
@GottaLaff@mastodon.social avatar

9/ McAfee says that Merchant needs to establish foundation for the source of Bradley's knowledge.

Merchant: When did the relationship start?

Bradley: I can't answer that.

GottaLaff,
@GottaLaff@mastodon.social avatar

10/ Merchant: When did you first have knowledge of their relationship?

Bradley: I've said time and time again that I don't have knowledge of when the relationship began. So I can't answer that.

GottaLaff,
@GottaLaff@mastodon.social avatar

11/ Merchant: When did you first know about the relationship?

Bradley: I don't know how to answer that...I can't give you a date. If you're asking how I got the knowledge, it came directly from a client.

Merchant: So you don't know a specific date?

Bradley: No.

GottaLaff,
@GottaLaff@mastodon.social avatar

12/ Merchant: Did you know in 2019?

Bradley: '19, I would probably say no....At this time, I'm telling you that I do not have the date.

Merchant: You received contract from Willis in Jan. 2021. Using that date, had they begun a relationship?

Bradley: I don't recall.

GottaLaff,
@GottaLaff@mastodon.social avatar

13/ Merchant: Do you remember knowing Willis prior to her taking office?

Bradley: I knew her very little before she was DA.

GottaLaff,
@GottaLaff@mastodon.social avatar

14/ I'm watching, and Squeaky is struggling, judge has to keep coaching her. Judge is losing patience.

WiseOldGrump,

NFL so she ignores this throwaway comment, but also for laffy for the lols

GottaLaff,
@GottaLaff@mastodon.social avatar

15/ Merchant: Do you remember telling me that not many people knew where they met?

Abbate: Objection, lack of foundation.

Merchant: Where did you gain knowledge of your statement that Willis and Wade started when she was judge in South Fulton?

Bradley: I was speculating

GottaLaff,
@GottaLaff@mastodon.social avatar

16/ Bradley: I was speculating...no one told me that. I never witnessed anything...it was speculation. I can't tell you anything specific as to why I speculated about that. It was many years ago.

Merchant: Did you have reason to lie to me?

Bradley: Idk if speculation is lying

GottaLaff,
@GottaLaff@mastodon.social avatar

17/ Via Kyle Cheney:

Wade's former partner, Terrence Bradley, says he can't recall if Wade and Willis were in a relationship at the time they hired him at the DA's office in 2021. He says he can't recall.

The lawyer for Mike Roman, Ashleigh Merchant, is struggling to establish much of anything.

GottaLaff,
@GottaLaff@mastodon.social avatar

18/ Bower:

Merchant: What did Nathan Wade tell you about the relationship?

Bradley: I recall him stating that at some point they were dating. I can't tell you what date that was. We were in our offices. There was no one else present. That's all I can tell you at this time.

GottaLaff,
@GottaLaff@mastodon.social avatar

19/ Merchant: You had one conversation with him about Willis?

Bradley: One time. I only recall one time.

Merchant: Was it before you got the 2021 contract w/ Fulton County?

Bradley: I do not recall.

GottaLaff,
@GottaLaff@mastodon.social avatar

20/ Merchant: You received an email from me on Jan. 6 w/ my motion to disqualify attached. And you I spoke about it. Do you recall?

Bradley: I can't recall if it was text/phone...we discussed the accuracy of how much money my office received & if that would go in the motion

GottaLaff,
@GottaLaff@mastodon.social avatar

21/ Bradley: I didn't reach out to you and say send me a copy of your motion. But I looked at it and I noticed that you had left out my part of the money the partnership received through my part of the firm. So I said that should be put back in for accuracy.

GottaLaff,
@GottaLaff@mastodon.social avatar

22/ Merchant: And then I asked you if the motion to disqualify was accurate and you said "looks good"?

Bradley: Yes, but "looks good" was applying to the accuracy of how much money my firm made through its contract w/ DA's office...not motion as whole

Eddiethebulldog,

@GottaLaff OOF. She keeps falling on her own knife here. He is NOT helping her at all.
This is the exact same way they went after Willis and Wade - TELL ME WHAT I AM ALLEGING IS TRUE! And all they're getting is - "you're out on your own limb and sawing it off, sister"

GottaLaff,
@GottaLaff@mastodon.social avatar

23/ Merchant: But I asked you in my email "Anything else that looks inaccurate?" And you responded "looks good." Isn't that right?

Bradley: Again, I was responding to the amount that my firm made from the contract w/ the DA's office, not anything else.

GottaLaff,
@GottaLaff@mastodon.social avatar

24/ Judge has to keep telling Merchant how to do her job.

This is going nowhere. At least not yet. And it's really frustrating to watch her badger him.

GottaLaff,
@GottaLaff@mastodon.social avatar

25/ Merchant: What did Wade tell you about he and Willis meeting at her office in Evans?

Bradley: I can't recall what the conversation was...I do recall knowing that he would go down to the office but can't tell you when or what happened there.

GottaLaff,
@GottaLaff@mastodon.social avatar

26/ 🤦🏻‍♀️ Merchant: Wade told you they had sex at that office?

Bradley: I don't recall.

Merchant: Do you recall Wade telling you that he had a garage door opener to access one of Ms. Willis's residences?

Bradley: No, I don't have any knowledge

GottaLaff,
@GottaLaff@mastodon.social avatar

27/ Merchant: So when you told me that he had a garage door opener for Willis's residence, you were lying?

Bradley: I don't recall telling you that....

GottaLaff,
@GottaLaff@mastodon.social avatar

28/ Merchant: Do you remember telling me that it didn't surprise you that Willis and Wade took many trips together because they also took trips together to Florida, Texas, etc.?

Bradley: I don't recall that.

JanisKay,
@JanisKay@mastodon.social avatar

@GottaLaff apparently she can’t find the texts to which she’s referring. Dare I ask if they even exist?!

GottaLaff,
@GottaLaff@mastodon.social avatar

29/ Merchant proffers exhibits showing some of her texts with Bradley in which he made comments about Willis and Wade taking trips together.

McAfee is getting impatient with Merchant's line of questioning...he says she needs to move on soon.

GottaLaff,
@GottaLaff@mastodon.social avatar

30/ Merchant: Wade didn't tell you about his visits to Ms. Willis's home in Hapeville?

Bradley: He did not give me details...At this time, I don't recall, no.

Merchant: Where did you get that information?

Bradley: I don't recall where I got that info.

GottaLaff,
@GottaLaff@mastodon.social avatar

31/ Merchant: You definitely did not want to be a witness in this case?

Bradley: Correct.

Merchant: After Gabe Banks (an attorney/friend of Bradley & Willis) called you, it was after that that you hired your attorney, BC Chopra?

Bradley thinks it was before but not sure.

GottaLaff,
@GottaLaff@mastodon.social avatar

32/ Merchant: You called and texted me after Gabe Banks called you?

Bradley: yes

Merchant: And at that time you didn't say anything to me about being represented by Chopra?

Bradley: yes

Judge just told Squeaky he'd cut her off after 5 more minutes. He's had it.

Lizette603_23,
@Lizette603_23@mastodon.social avatar

@GottaLaff she's a fool with no talent for the job she's in.

GottaLaff,
@GottaLaff@mastodon.social avatar

33/ Merchant: Do you recall me asking you if the relationship started before she hired him and you replied "absolutely"?

Bradley: Yes

Merchant: And I asked you how they would react, and you said they would deny it?

Bradley: I see that's what the message says

GottaLaff,
@GottaLaff@mastodon.social avatar

34/ Sadow is up now.

GottaLaff,
@GottaLaff@mastodon.social avatar

35/ Appearing via Zoom, Steve Sadow, on behalf of Trump, has a few questions for Bradley.

Sadow: You have referred to Wade as your client?

Bradley: Correct.

GottaLaff,
@GottaLaff@mastodon.social avatar

36/ Sadow: When you say you have no personal knowledge, I want to know if you had communications w/ Mr. Wade about the relationship with Willis?

Bradley: Yes

Sadow: And is it your testimony that you only had one conversation w/ Wade about his relationship with Willis?

Bradley: Yes

GottaLaff,
@GottaLaff@mastodon.social avatar

37/ Sadow: So in 4 1/2 years in which you represented Wade, you only had one conversation about Ms. Willis?

Bradley: I don't recall having any other conversation with Wade about Willis.

Sadow: There wasn't another convo or you don't recall?

Bradley: I don't recall

jmcrookston,
@jmcrookston@mastodon.social avatar

@GottaLaff

I always hate that question.

Q. There were no other conversations or you don't remember any other conversations?

A. Well since all I can do is give you my recollection. My recollection is that there were no other conversations. I can't be more definitive than that because I'm working from my own brain's memory. 🤷

GottaLaff,
@GottaLaff@mastodon.social avatar

38/ Sadow keeps using "under oath" in his questions... implying Bradley is lying. It's so disgusting.

Sadow: Do you recall anything that would indicate when Wade's relationship w/ Willis started?

Bradley: I don't recall anything that would indicate that

GottaLaff,
@GottaLaff@mastodon.social avatar

39/ This judge sure overrules the Fani/Wade side a lot.

Sadow shows Bradley a text in which Merchant asked him "do you think it started before she hired him?" and Bradley replied "absolutely."

Sadow: After you said "absolutely," you said "It started when she left DA's office & was judge in South Fulton"?

Bradley: I was speculating

GottaLaff,
@GottaLaff@mastodon.social avatar

40/ Sadow: And your testimony under oath is that you on your own came up with the notion that it started when she was a judge in South Fulton?

Bradley: Yes, that was speculation on my part

Sadow: Had nothing to do w/ what Wade told you?

Bradley: Yes, I was speculating

GottaLaff,
@GottaLaff@mastodon.social avatar

41/ Sadow: Why in the heck would you speculate as to that?

Bradley: I was speculating...I knew they met at the municipal court conference in 2019.

Sadow: Who told you that?

Bradley: Wade

Sadow: So you had more than 1 convo w/ Wade about Willis?

Bradley: That's incorrect

GottaLaff,
@GottaLaff@mastodon.social avatar

42/ Sadow is yelling, trying so hard to project "gotcha". God he's an ass.

GottaLaff,
@GottaLaff@mastodon.social avatar

43/ Sadow: You knew Ashleigh Merchant represented a defendant in this case and so you knew when she was asking you these questions that she was trying to establish when they met?

Bradley: No, that's not 100% correct...

GottaLaff,
@GottaLaff@mastodon.social avatar

44/ Sadow: So why would you speculate as to that?

Bradley: I don't know

Sadow: The real answer is because you don't want to testify to the actual facts in court?

Bradley: No, I've stated I don't have knowledge of when it began

GottaLaff,
@GottaLaff@mastodon.social avatar

45/ Sadow: Why wouldn't you just say "I don't know" if you didn't know?

Bradley: I can't answer that

Sadow: You want the court to believe that you decided on your own to speculate?

Bradley: Yes, I've stated that I speculated

GottaLaff,
@GottaLaff@mastodon.social avatar

46/ Sadow proffers text in which Merchant asked Bradley if the following statement was accurate: "On information and belief, Willis and Wade met at a magistrate court conference and began a relationship shortly thereafter..."

Bradley replied: "No, it was municipal court."

GottaLaff,
@GottaLaff@mastodon.social avatar

47/ Sadow: You didn't say no, they didn't begin a relationship shortly thereafter?

Bradley: No, but it was a compound question...I was correcting which conference they at

Sadow is pounding away at this, yelling (well, speaking LOUDLY) and judge finally cuts him off. Tells him to move on.

GottaLaff,
@GottaLaff@mastodon.social avatar

48/ Sadow repeats question about why Bradley was speculating... judge cuts him off and says pretty much, been there done that. Move on.

Seriously, Merchant’s lawyer is blaming Bradley for not proofreading her motion and telling her there was a factual inaccuracy. This is the kind of thing you explicitly clarify in writing. You don’t leave it open to interpretation.

Elsehere,
@Elsehere@mastodon.social avatar

@GottaLaff NFL

It's a shame that Bradley isn't just saying it clearly: "I can see how someone could read my response as a statement that everything in that draft is accurate. However, that was not my intent. My statement was merely meant to comment that the fact she added at my request was accurate."

GottaLaff,
@GottaLaff@mastodon.social avatar

51/ Allyn Stockton, for Giuliani, is up.

Stockton: You indicated that the contents of Merchant's DQ motion were accurate?

Bradley: She asked in email if the motion was accurate, but I responded in a text chain about a specific fact in the motion, not the motion as a whole.

Elsehere,
@Elsehere@mastodon.social avatar

@GottaLaff NFL

I also think it's telling (sorry if I missed it) that none of these defense attorneys have asked him straight-out, "Did the defense attorney ask you to write a declaration as to your personal knowledge in support of her motion." The answer would be sure to be telling.

GottaLaff,
@GottaLaff@mastodon.social avatar

52/ Stockton: You knew that Merchant was relying on the information you gave her for this motion?

Bradley: I didn't know that...

Stockton: You would tell Merchant if something was patently false in that motion?

Bradley: I don't know what I would have told her

GottaLaff,
@GottaLaff@mastodon.social avatar

53/ This is insane.

And losing. Wah, so sad.

GottaLaff,

In what has mostly been a painful and newsless hearing, it's quite remarkable to hear Wade's former law partner say he 'can't recall' whether he lied to defense attorneys about Wilils and Wade's relationship.

Meantime, I'm trying to find Bowers' thread. It broke so I'm struggling to figure out where she left off.

GottaLaff,
@GottaLaff@mastodon.social avatar

55/ Found it. Bowers:

Rice: Did you lie to Ms. Merchant when you told her facts about Willis's relationship with Wade?

Bradley: I speculated on things...and I've testified to what I did know...I don't recall whether any of it was a lie or not.

(Judge has done a lot of cutting off/asked and answered rulings.)

Stinson_108,

Now lawyers are arguing about the chain of text messages. Apparently Squeaky didn't include all of them. She skipped a month or 2.

The various lawyers are blaming each other for whose failure all this was: Should defense include them all, should prosecution have asked for them? It's all so annoying right now.

GottaLaff,
@GottaLaff@mastodon.social avatar

63/ Apparently, Squeaky demanded her phone back before all the texts could be included. Squeaky said she'd now print a readout of all of the texts. Judge said that works.

Squeaky is still defending herself for omitting texts. Judge shut her down: "We're done."

Judge is talking about hearing arguments on Friday, will make a ruling at some point.

I don't quite follow all they're saying, sorry.

GottaLaff,
@GottaLaff@mastodon.social avatar

64/ So: Friday they do arguments, talk disqualification and forensic misconduct (Don't ask me, no idea what that's about), and judge's court has 2 weeks of a homicide trial after Friday.

No, we don't, but based on the law and evidence an educated guess says the burden required to grant the motion was not met and he will rule accordingly.

What many are missing (but not the Lawfare folks who've been on top of it) is that there was significant liability lurking out there that is being dealt with before it could really screw the pooch.

@zenkat Just read my thread, that you replied to. I live posted the whole thing. @JamesGleick

GottaLaff,
@GottaLaff@mastodon.social avatar

@zenkat Basically, they tried to paint Willis as a liar. They know they lost the other arguments against her, so this is their Hail Mary. @JamesGleick

zenkat,
@zenkat@sfba.social avatar

@GottaLaff @JamesGleick Thx. Without knowing all the names & what angles they're trying to play, it was all a bit confusing.

Found this article, it gives some more context ... https://newrepublic.com/post/179339/key-witness-georgia-fani-willis-crumbles

GottaLaff,
@GottaLaff@mastodon.social avatar

@zenkat Oh good. Yeah, too many players. @JamesGleick

zenkat,
@zenkat@sfba.social avatar

@GottaLaff @JamesGleick Thx for the play-by-plays, BTW! Def appreciate them. It's just this BS is such silly high school gossip that my mind is basically refusing to process it.

But it also has the stink of so many other things these days ... feeling like the fix is in, too much money and too much power is too far invested in oligopoly.

GottaLaff,
@GottaLaff@mastodon.social avatar

@zenkat I couldn't agree more. My mantra. @JamesGleick

leswarden,
@leswarden@mastodon.world avatar

@GottaLaff I lay most of this ridiculousness at the Judge’s feet. They shouldn’t be down this rabbit hole.

Two consenting adults who banged each other! SO WHAT!?!
What’s that got to do with prosecuting a case?!? I’ll tell you what..NOTHING!

But we know this, and we know what this is all about..cough, cough.. & !
Disgusting, and the Judge should nip it NOW!

GottaLaff,
@GottaLaff@mastodon.social avatar

@leswarden Nip it now? The hearings are over, it's way too late for that. They've smeared and insulted her ad nauseam.

leswarden,
@leswarden@mastodon.world avatar

@GottaLaff I can’t dispute that. 😢 The judge has shown his incompetence and inexperience by not seeing the true design. 😡

GottaLaff,
@GottaLaff@mastodon.social avatar

@leswarden He sure has. Sigh.

GradientU0,

@GottaLaff I suspect Squeaky may have broken her own A-C privilege in discussions she omitted in the text messages, which would open the door for the DA to dig up more if they so desire.

GottaLaff,
@GottaLaff@mastodon.social avatar

@GradientU0 How would that break privilege? And nobody seemed to bring that up.

GradientU0,

@GottaLaff If she discusses items/information that are subject to A-C privilege of another client with a non-client, then she may have exposed her actual client and the underlying information.

GottaLaff,
@GottaLaff@mastodon.social avatar

@GradientU0 I'm not following... where did she do that?

GradientU0,

@GottaLaff It might be the reason she omitted intervening texts with Bradley re "Now lawyers are arguing about the chain of text messages. Apparently Squeaky didn't include all of them. She skipped a month or 2."

GottaLaff,
@GottaLaff@mastodon.social avatar

@GradientU0 Oh, got it.

I guess they'll hash that out.

btrinen,
@btrinen@social.seattle.wa.us avatar

@GottaLaff This whole things seems like an extraordinary hearing to be having with no real evidence other than what they hoped would be a bombshell from a second hand witness who didn’t want to be there. The original morion promised so much more.

GottaLaff,
@GottaLaff@mastodon.social avatar

@btrinen They kept using their Perry Mason a-HA! voices. So idiotic.

MiriShuli,
@MiriShuli@mstdn.social avatar

@GottaLaff But it is now on records that “he lies”. Man, Merchant must be turning cartwheels.

Eddiethebulldog,

@MiriShuli @GottaLaff it's not a big win to get on the record that YOUR witness lies. That's what's KILLING me here. He's not Wade or Willis' witness - he is the complainants witness and apparently ONLY witness and he is not only NOT helping them ... he's painting them as very incompetent to have relied on him to make the case for their complaint.

GottaLaff,
@GottaLaff@mastodon.social avatar

@Eddiethebulldog Shorthand for me. I don't know the right terms. @MiriShuli

DoctorDNS,
@DoctorDNS@masto.ai avatar

@GottaLaff it is laughable - but Bradly is hardly a nice guy.

stevencworlds,
@stevencworlds@mstdn.social avatar

@DoctorDNS @GottaLaff honestly, if I had to sit in a court trying to explain inconsistencies with lawyers who insist on getting “gotcha” soundbytes from speculation alone, I wouldn’t be a nice guy either.

Anchorstine,
@Anchorstine@sfba.social avatar

@GottaLaff Thank you for all the narrative.

GottaLaff,
@GottaLaff@mastodon.social avatar
Eddiethebulldog,

@GottaLaff the assumption that he would have done the job of the petitioner's lawyers should have gotten a reprimand. My question as the judge would have been "is he your witness or part of your legal team?". He's apparently neither, btw.

Eddiethebulldog,

@GottaLaff exactly - and he's a LAWYER! You would have PAID him to do that. As a witness, he would do exactly what he's describing - vouching for the section he thinks he provided, not the entire motion. He can't assume he's the only witness. smh

Wileymiller,
@Wileymiller@mastodon.social avatar

@GottaLaff
Sooooo...it takes 3 lawyers to ask him the same questions, over and over and over?

GottaLaff,
@GottaLaff@mastodon.social avatar

@Wileymiller And then he said he can't remember if he lied about his friends. Sigh

mwyman,
@mwyman@mastodon.social avatar

@GottaLaff @Wileymiller seems inconceivable to the defense attorneys thought they’d rely on his comments, and none of those jokers asked him for an affidavit attesting to certain facts beforehand.

Stinson_108,

@GottaLaff
Steve is lead counsel for Donald . Of course he yells louder than any of the other attorneys. is probably watching. He wants to make sure he's getting the most for his contributors' money.

Eddiethebulldog,

@GottaLaff it's funny when the Trump lawyers get the treatment they coach the Trump family to use when questioned.
"I don't recall." is Ivanka's ringtone.

tdwllms1,
@tdwllms1@mstdn.social avatar

@GottaLaff

NFL... the judge has turned this whatever ya wanna call it case into a shitty useless side show no relevance to anything ...

Lizette603_23,
@Lizette603_23@mastodon.social avatar

@GottaLaff and she does

Eddiethebulldog,

@GottaLaff it seems like a hail mary and the judge is giving her all KINDS of leeway. It's easy to see how both Wade and Willis lost their patience with her. i just don't get how this is allowed to go on, but as Teri Kanefield often advises - it's all part of the game.

GottaLaff,
@GottaLaff@mastodon.social avatar
tdwllms1,
@tdwllms1@mstdn.social avatar

@GottaLaff

NFL...

this is looking more and more like a kangaroo court...

specked,
@specked@social.right.wtf avatar

@GottaLaff Perhaps I should have pursued law. It appears that any idiot can make money in it if Ms. Merchant is anything to go by.

dougiec3,
@dougiec3@libretooth.gr avatar

@specked @GottaLaff
Maybe just the caliber of legal representation T**** can afford now? An Opportunity!- no pay, but lots of exposure!

GottaLaff,
@GottaLaff@mastodon.social avatar

@dougiec3 She represents Mike Roman. @specked

Eddiethebulldog,

@GottaLaff at what point does the judge call out this badgering? i mean - he has answered this question four or five times now. This is not the witness Merchant thought he was and the whole issue of a foundation ... for credibility ... is completely missing, and she can't get him to create one for her.

TCatInReality,
@TCatInReality@mastodon.social avatar

@GottaLaff
Great answer.

"I don't know if speculating is lying" 🤣🤣🤣

lesblazemore,
@lesblazemore@mastodon.social avatar

@GottaLaff this won't be threaded so...

>>Merchant: Do you remember telling me via text that you told me the relationship started when Willis was a judge in South Fulton?

>>Bradley: I see the text but don't recall sending the message.

That's a great way to get started with your key witness
