If SCOTUS remands the J6 case back to Chutkin to figure out what acts were official vs personal based on whatever Bizarro logic they come up with, she should just turned around and schedule a VERY in depth fact finding trial on that point, going into excruciating detail on exactly what Trump did and when and why. This fall. Very fucking publicly.

The Supreme Court (majority of 5) is wrong. The Court has no authority to erase the plain meaning of the Constitution. But there is no institution to appeal to - other than the voters. Voters can choose to follow the plain meaning of the 14th Amendment and determine for themselves that someone is not qualified to hold office. And then vote for the other guy.

Today has been an absolutely craptastic day for the rule of law.

Saying that there has to be a uniform rule for applying 14.3 for federal offices would be one thing. It’s not a terrible principle, just one not present in the text, so it would save Trump while showing how bankrupt the so-called “originalist” framework is. Ok.

Today SCOTUS began interfering in the election -- by putting an unnecessary delay getting key information to voters that is important to their voting decisions.

You think that we know all the evidence Jack Smith has? We do not. We're only going to find out during trial.

And we're only going to see how that evidence holds up, or doesn't, at trial.

That's WHY WE HAVE TRIALS. Voters deserve to have the question about whether a candidate is an insurrectionist heard before the election.

While the Supreme Court is pondering whether one part of the 14th Amendment (Section 3) is more like what you might call guidelines than actual law, it may be worth reviewing New Jersey's early tradition of enfranchising women and others to vote, and why how that right was stripped from them in 1807:
