Rule of thumb: a "Smart %thing" is a %thing that is more likely to lead to unexpected harm but saves (or makes) someone other than those exposed to it a bunch of money.

I think they are doing well actually. As they start to include open source in their thinking a variety of issues will be exposed. The big question is what they do about each as they arise.

    Do you have sources for that assertion? https://doi.org/10.18757/jos.2022.6695 suggests there is no such easy access to groups of patents for most SEPs.

    Also, I don't think that's what "patent thickets" means. A patent thicket is a group of overlapping patents in a specific industry owned by many different companies. This creates a situation in which the firms prevent one another from innovating.

    But this is outside the scope of SEPs, which are the topic under discussion. SEPs (for example related to ETSI stanards) seem rarely to be available via patent pools.

    If the comes in in the UK and requires us to seek age verification, thus increasing the likelihood that we would need to store personal records for users, then we will be shutting down our site and absolutely not participating in that process. This is a recipe for a privacy disaster. We take great pride in storing as little as possible of your personal information and don't want to store more just because a fascist government wants even more control then they already do.

    But the problem is with not being able to know without seeking legal advice, and even then being told "maybe" and still left to decide yourself. It's why we will see lots more 451 pages soon.

    While respecting Hanlon's Razor, I am tempted to see it as a design feature rather than a bug -- by people unaware just how extensive the impact of uncertainty will be on the Fourth Sector -- to make all sorts of "dirty things" (in their view) vanish without a need to legislate further.

    I keep hearing things like that. But you can't use civil law to disclaim a criminal act, and this new law basically identifies knowingly leaving consumers with a vulnerable device as criminal.
