The license change is just the most recent example of a company that no longer needs to drive adoption with claims. I wrote about the phenomenon in 2021 but it's been around for about 20 years. It is not "the end of open source", just a lifecycle stage for a VC funded software startup that was leveraging it.

@sjn Licenses that are used without a CLA are good, especially if they include copyleft provisions.

I have added an update to "Not Using Zoom" to reflect the ToS change just pushed (around 17:00 UTC I think).

tl;dr: Doesn't seem to really fix the issue.

Zoom's ToS just changed.

https://explore.zoom.us/en/terms/

10.4 has had the addition "Notwithstanding the above, Zoom will not use audio, video or chat Customer Content to train our artificial intelligence models without your consent."

No word about the other kinds of Customer Content (or indeed Customer Input).

Effective 27 July changed their terms of service (T&C) whereby without opt-out YOU give them consent to perpetually use your content (video, audio,…) also for “training and tuning of algorithms and models”.
https://stackdiary.com/zoom-terms-now-allow-training-ai-on-user-content-with-no-opt-out/

Check for yourself:
https://explore.zoom.us/en/terms/
Compare with the version archived 25 July by :

webmink,
@webmink@meshed.cloud avatar

@mfriess
In addition to all this, in 10.6 you "represent and warrant that you have the right to upload Customer Input and for Zoom to provide, create, or make available any Customer Content to you, and that such use or provision by you, your End User, or Zoom does not violate or infringe any rights of any third party."

So you are basically indemnifying them if they train their AI with someone else's IP you are discussing internally via Zoom.

I would have more patience for the argument that is dead were it not for the fact the people making the argument are benefiting from huge quantities of the stuff and would rather their customers didn't benefit the same

    A "just obey the law" clause in an (or wannabe) license is so pointless it's possibly just projection of the intent of the author to do otherwise...

    While F-Droid appears to be "just" an alternative for , it is actually the apex of a lifestyle movement that's choosing to use Android only with and without or advertising-related . Realising that makes many of its features - and shortcomings - easier to understand. I was the main interviewer in the discussion this week on Weekly with core @fdroidorg developer @eighthave and it was a good show.

    If someone is so motivated by a crime that the law and its sanctions don't stop them, do you seriously think they will reconsider just because you might sue them for infringement of your license? What do you think you can do about it that the state can't?

    Seriously, don't use "just obey the law" clauses like Meta just did in their not-open-source AI license.

    Unfortunately the late changes ITRE made seem to make things worse, not better. As they are now final texts, that means we are going forward with a bill that makes regular donations to projects like @libreoffice turn them into commercial projects and which discourages companies contributing to (). It looks a real mess to me.

    It's time for Europeans to start writing to their MEPs about the Cyber Resilience Act. It has recently been modified in a way that will be very harmful to projects.

    This article from Github does a good job explaining the issues. Those first two issues are the ones that have been recently and intentionally introduced. Your MEP probably doesn't know and still thinks open source has been excluded from the scope.
