Big Met Its Match When It Turned Down a Top Trial Lawyer’s Request for Treatment

Blue Cross and Blue Shield denied payment for the proton therapy Robert “Skeeter” Salim’s doctor ordered to fight his throat cancer.

But he was no ordinary . He was a celebrated litigator.

And he was ready to fight.

@ProPublica British Politicians to the British Public "yes, but ignore all this, we still think the US Healthcare system is right for you, just shut up and do as you're told"

@ProPublica

Our "healthcare" system is an unbelievably bad and cruel joke, glad rich guy here was able to fight his own battle, but millions more can't. Man, good thing we avoided the so-called "death panels" and didn't get that single payer/public option! Much better having for-profit death panels standing between us and our doctors, deciding what treatments our doctors can do for us.

Read word-for-word. Only one comment:

APPLAUSE

fencepost,

@ProPublica I'm sure the insurer would fight it but I'd love to see counts of how many times they approved and denied the therapy - and whether there were common elements eg "we approve it for BCBS executives"

@ProPublica @IAmDannyBoling We need to eliminate private [edited to add:] medical insurance companies in the USA.

@ProPublica

U.S. healthcare is a broken system. Frankly, it was broken from the beginning. Insurance companies and a compliant Congress continue to make it worse.

@ProPublica Tell me again about socialised medicine and its Death Panels.

@ProPublica
Here's the kicker:
"Salim is expecting the full $95,862.95 he paid. However, court records show that Blue Cross has said it only needs to pay Salim the discounted rate it had negotiated with MD Anderson at the time of his radiation treatment: $35,170.47. That’s what Blue Cross would have paid if its doctors had said yes in the first place."

Blue Cross Blue Shield would rather spend untold millions to fight for their right to deny care rather than paying far less to set a precedent for providing appropriate care.

And this is why US, for-profit insurance premiums increase each year.

NerdRage42,

@ProPublica I actually learned a lot from this article and I'm now saving the link in my notes for future reference because I live in America and you have to be incredibly dilligent when fighting these big companies that will throw you under a death bus when you get sick.

famirafilms,

@ProPublica ok, I’ll watch that movie. Sounds like Batman for grownups.

@ProPublica I have blue cross blue shield and their medical experts decided that Tysabri- an MS med I’ve been on for 10 yrs wasn’t medically necessary for 3 infusions in the last year.

Apparently the pre-approval got lost in their system and they decided my MS went away 3 times and then came back. They weren’t even consecutive treatments.

They’ve finally agreed to pay for of them, one is still pending but the one from 11/9/22 was finally approved 11/2/23.

@ProPublica Good for him. Excellent story.

As the press you are celebrating an child freed of the orphan killing machine, yet never questioning why an orphan killing machine exists as other children are thrown into it. But this child lived!

Couldn't even find someone to talk to who was killed or maimed by this practice, just the person who had the means to save themselves and fight.

It's a tragedy presented as a success story.

tutwilly,

@ProPublica sounds about right. You need to be a lawyer who is willing to sue, to get healthcare
