Debt collectors don't have to prove anything to you.

There's only one time a debt collector has to prove anything, and it's never in response to a letter or other dispute from you.

The law does NOT require them to send you "proof" of the debt after you dispute.

It does not require them to send you proof of ownership.

It does not require them to send you a wet-ink contract.

It does not require them to send you anything at all, besides the most basic information about your account.

The only time they have to prove anything is... when they're in court.

If they sue you for the debt, then yes, they'll have to bring evidence of the debt and their right to collect.

But what if they don't sue you? What if you still want proof?

A lot of people think they can't be garnished but they don't really know what that means.

They've seen videos or read information telling them that certain income sources, like social security benefits, can't be garnished by a debt collector, and they think that makes them safe.

It's polite to respond to a letter.

But it's not required.

When you send a dispute letter to a debt collector, you might think they have a certain time limit to respond to you with the requested information.

A lot of people do think that.

But it's wrong.

A debt collector never has to respond to you if they don't want to.

They just have to stop collecting until they do.

So if you've sent a dispute letter and you're looking into an empty mailbox, it's likely they've just given up on you.

And sometimes, that's exactly what you want them to do.

It's a nasty surprise, and it comes from the worst possible place: your boss.

When a debt collector garnishes wages, the first person they have to tell is not youβ€”it's your employer. So the garnishment is almost always a surprise.
