PRESS FREEDOM LEGAL UPDATE:

On Sept 27, Energy Transfer/DAPL appealed the MN District Court order finding UR & its journalists are protected by the Minnesota Free Flow of Information Act (MFFIA): https://donorbox.org/unicorn-riot-nodapl-legal-defense?t=updates#info

2 protestors concerning plans for the protests—including plans for unlawful activity—in order to coordinate Unicorn Riot’s presence at the sites and to facilitate its coverage of the protest activity. Appellants accordingly served Unicorn Riot and Niko Georgiades (collectively, “Unicorn Riot”) with subpoenas duces tecum aimed at discovering documents and information relevant to Appellants’ claims against Greenpeace. Despite its own participation in the tortious conduct at issue in the underlying suit, Unicorn Riot refused to produce a single document, claiming that all of its unpublished information was privileged under the Minnesota Free Flow of Information Act (MFFIA). The district court agreed with Unicorn Riot that the unpublished information was privileged and denied Appellants’ motion to compel. The MFFIA, however, applies only to legitimate, lawful newsgathering activities. It does not apply to protect information that is obtained or created as a result of a newsgatherer’s unlawful conduct. The district court therefore erred when it ignored Unicorn Riot’s tortious conduct in participating in the trespass on Appellants’ pipeline sites and found that the information gathered during, and related to, that unlawful conduct was privileged under the MFFIA. This Court should reverse the district court’s denial and remand for reconsideration of Appellants’ motion to compel.
16 B. The MFFIA does not shield Unicorn Riot from compliance with Appellants’ subpoena because Unicorn Riot’s activities went beyond lawful newsgathering when it engaged in deliberate, unlawful trespass onto Appellants’ construction sites. Unicorn Riot, as the party objecting to a valid subpoena, has the burden of proving that the MFFIA privilege applies to shield the relevant documents and communications from disclosure. See Brown v. St. Paul City Ry. Co., 62 N.W.2d 688, 701 (Minn. 1954). It cannot meet that burden because its activities in this case went beyond legitimate newsgathering when it engaged in deliberate, unlawful trespass onto Appellants’ private construction sites. The MFFIA’s protection is limited to the lawful “gathering, procuring, compiling, editing, or publishing of information for the purpose of transmission, dissemination or publication to the public.” Minn. Stat. § 595.023. Here, Unicorn Riot went beyond those lawful, protected activities. Unicorn Riot was not merely a neutral observer in this case: as its own videos show, Unicorn Riot’s coverage was entirely in favor of the protestors and against the pipeline and the law enforcement officers who attempted to maintain order and enforce Appellants’ right to construct the pipeline. Unicorn Riot does not, and cannot, dispute that its reporters trespassed onto pipeline worksites as they took video footage of protestors who were also illegally present at the sites for the express purpose of obstructing the
17 By acting in concert with the protestors in entering onto pipeline construction sites without permission, Unicorn Riot stepped outside of the protection afforded by the MFFIA. Its communications and other documentary materials related to the planning, support, and commission of the unlawful trespass onto private pipeline construction sites are therefore discoverable, not subject to any privilege, and should be produced. This Court should reverse the district court’s denial of Appellants’ motion to compel, clarify that the MFFIA does not apply when purported newsgatherers engage in unlawful, tortious conduct, and remand to the district court to reconsider Appellants’ subpoena requests accordingly. III. First Amendment protections do not apply to excuse Unicorn Riot’s refusal to comply with Appellants’ valid subpoena. Unicorn Riot also objected to Appellants’ subpoena based on a claimed privilege under the First Amendment. (Doc. 25 at 10-12.) The district court declined to consider this argument in light of its conclusion that the documents were privileged under the MFFIA. (Add. 8.) For the same reasons that the MFFIA does not apply, the First Amendment does not relieve Unicorn Riot of its obligation to comply with Appellants’ subpoenas. First, neither the United States Supreme Court nor the Minnesota Supreme Court has explicitly recognized a journalist’s privilege under the First Amendment. See e.g., Weinberger v. Maplewood Review, 668 N.W.2d 667, 671 n.5 (Minn. 2003) (decl
