👋 Howdy! I'm the Director of Product Engineering for the group that includes the Jetpack plugin and Jetpack things like our data sync.

I totally understand the concern regarding the news yesterday about Automattic's AI data handling.

Jetpack sites are not included, no matter what Jetpack features you have enabled (enhanced distribution, blaze, publicize, etc).

Only public sites/content hosted with WordPress.com (or Tumblr).

@kraft eh. I'm glad of that but given the IMHO shambolic rollout of Stats I'm taking this as a "for now."

I understand this is not a one person show, but the goodwill from Automattic as a corp is burning up fast.

@flameeyes Yeah, we're moving slow on Stats (e.g. no enforcement yet) because we are wanting better ways of determine commerical. A few affiliate links that makes you $100 a year doesn't make you commerical. If you're using sponsored posts, have merch, etc, more inclined that you're commerical.

We are trying to find a reasonable balance there.

@kraft the problem is the disconnect between the stated intention and what the terms end up stating. One would have to trust the intention, rather than the letter of the terms and...

... well that's where you're now, having to explain that what the terms say is what matters, despite a track record of not quite meaning it.

I can't say I envy your position 😅

@flameeyes that's fair. I can appreciate both sides. As written, it gives us more flexibility to handle unexpected situations, but that doesn't help the regular 99% of folks out there who aren't the reason we have stricter terms.

It's also tough to craft terms too. I had a conversation with the lead who is working on this now and discussing the idea of a threshold trigger. Any "commercial" signal is worth X points and only if you exceed Y, it flips.

@flameeyes so maybe having WooCommerce is 50 points and 50 points is the trigger point. You're selling stuff, so you're commercial.

Or, maybe it is worth 25 points and we look at traffic to your checkout page or something (just riffing) for when it exceeds a point.

I don't know how to write that into legal terms that are also transparent. But, IANAL so that wouldn't be my job either way. 😂

@kraft I'm honestly glad to hear it's at least being looked at. I can imagine how hard it is, particularly to make sure it's actually enforceable.

To be honest, personally it would have sounded less of a risk if there was a lower-priced tier to just pay for and be done with it. (But then, it needs to be reliable. Last I used it, as I wrote, it still couldn't tell different Android apps apart!)

But again, I'm seeing it only on the receiving end 😅

Real irony, I’ve been a paid DayOne subscriber for a while. This really makes me think about the renewal
