Remember, DoJ asked SCOTUS to take the case and it declined—saying he had to go to the appellate court first. You could argue that was “ordinary,” if gratuitous.

Then the appellate court issued a unanimous—airtight—decision. Standard practice would’ve been for SCOTUS to let it stand a matter of days after being asked to do so.
Instead, it waited weeks to declare it would—unnecessarily—take the case, then scheduled argument for April.

That’s 100% delaying the case for the criminal defendant who is charged with the most serious crimes against the United States of America.

And now we see Alito was signaling support for the insurrection.
