Davidson, who already testified he was frustrated by a delay in receiving the payment, says in the email that it wasn't necessary for him to speak to Cohen, & that he just wanted to be paid.
"I used the holiday of Yom Kippur as a way of just once again trying to delay" the payment, Cohen says.
Davidson testified that was exactly what he thought Cohen was doing - & to try to push the issue to beyond the election when the story would no longer matter.

#MichaelCohen, reads emails he exchanged in 2016 w/ #KeithDavidson, #StormyDaniels's lawyer, says that the correspondence represented that “we were losing control over the settlement of this agreement in order to prevent” Daniels’s story from coming out. He says that loss of control was a “direct result of my failure to wire funds.” Reportedly there’s still anxiety in Cohen’s voice about that “failure,” nearly 8 years later.

Prosecution shows voluminous records of phone calls between #MichaelCohen & #HopeHicks after the article about #KarenMcDougal came out. If anything, these records make Hicks look as if she underplayed the amount that she was speaking to Cohen & his involvement in the campaign.

The jurors heard an audio recording of #KeithDavidson, #StormyDaniels’s fmr lawyer, telling #MichaelCohen that she was desperate for the money & was panicked that her leverage to get it would disappear after the 2016 election because she expected #Trump to lose. Davidson describes hearing Daniels say this to him on the phone, but Daniels denied it to the court shortly after the tape was played.
Defense’s goal seems to be to establish that she was motivated by money.
#StormyDaniels laid out the specifics of the #HushMoney deal. She said that if she were to violate the agreement, it would cost her a $1M every time she did so.
Daniels said she was not paid on time, & she wasn’t sure why. “He just kept making excuses,” she said. At first she said that the “he” in question was #MichaelCohen. But then she clarified that it was #Trump who delayed the payment — specifically, Trump speaking to Cohen, who was speaking to her then-lawyer #KeithDavidson.
#Necheles has hardly asked about the actual case — whether there was a #conspiracy to cover up a #HushMoney payment made before an election, & if business records were falsified in the process. Instead she has focused on whether Daniels embellished her story about being threatened in Vegas by someone connected to #Trump.
Necheles repeats the accusation: “That’s what you did, right?”
Daniels almost yells: “False!”
The defense has been building to this since Emil #Bove, accused Daniels’s lawyer, #KeithDavidson, of being a serial extorter of celebrities on behalf of other clients.

#Bove noted #KeithDavidson's use the word “leverage” on the tape, suggesting that he was seeking leverage over #Trump. Davidson denied that & said that Bove is “grossly mistaken about the dates” of when this conversation took place.
The recording was not introduced as evidence in the case so the jury & the observers aren’t hearing it. Davidson is listening on a headset, defense is using it to refresh his recollection about the conversation so Bove can question him about it.

In the recording Cohen said #Trump hated “the fact that we did it.” Davidson clarifies this in response to the #HushMoney payment to #StormyDaniels — a key piece of evidence, that would seem to corroborate Trump’s knowledge of & involvement in the deal.
#Bove briefly questioned #KeithDavidson again in a recross-examination. He ended it by emphasizing that Davidson had never been in a room w/ #Trump until this week.
"You never spoke to or never were in same room until Tuesday?," Bove asks Davidson.
Davidson said that was correct.
