🧵 (1/2) TODAY IS THE 10TH ANNIVERSARY OF MY MOTHER'S DEATH.
She was told she had "Stage 3 malignant #cancer" and given #Chemo. Her doctor didn't do ANY follow-up between treatments, which resulted in severe pneumonia and being rushed to the hospital.
The hospital screwed up, resulting in a collapsed lung after only 1 week.
3 days after that, she went into Cardiac Arrest. The collapsed lung hindered #CPR and left her a vegetable for 9 months.
🧵 (2/2) I tried to sue the hospital, but a 2004 #Texas#TortReform law (pushed by Gov Rick Perry and approved by TxSC Justice #GregAbbott) made it impossible.
When she passed away 9 months later, I ordered an autopsy.
#RobertaKaplan and #ShawnCrowley have demonstrated the highest ideals of the American #legal system. With tremendous skill and tenacity they used the law to demand and get civil justice for their client. Today, I am proud to be a scholar and teacher of American law, and specifically of #tort law (#defamation, the gravamen of #EJeanCarroll suit is a tort). “Is that… a rabbit that just went hopping by??” asked the man bringing the sewer line camera up. He loves rabbits, but was so shocked to see a free range hopper go by from her space station on her rug over the hardwood lava😂.
Unfortunately more bad news today- another sag by the house, a cracked pipe in another spot, nothing house insurance covers..😓We will talk to project mgr tomorrow but we financed the first project and don’t have anything left, so we will see! Our house is 15 years old..
One of the problems with trying to hold the builders responsible is that the terrible ones you would actually need to sue tend to "recycle" their business every year or two. They may still be operating, maybe even the same name, but it's a different corporation, and the old one is kaput with no assets to make a claim against.
When AI is used in medicine, things will go wrong & patients will get hurt.
(Just like medicine *without *AI! Hopefully less!)
Who should be liable?
Glenn Cohen & I have a surprisingly (we think) simple answer: hospitals. They're the last mile & can deal with contextual bias & in situ implementation. Lots of details! Default rules, switching! But that's the base.
