As much as I agree with you logically, and also disagree with what she did, we shouldn’t encourage people to avoid lawsuits to address injustice they perceived. That’s how we ended up with #metoo. So many on the entertainment industry not rocking the boat as it could damage their career. Some were blacklisted for speaking out, so it was a real fear.
If it was a real injustice the same logic would apply and we should take that into consideration when we consider damages for real injustices.
I agree completely. I had the same concern as I was writing my comment, which is why I was careful to specify that it’s a nuisance suit. (Side note: autocorrect saved my butt. I can never remember how to spell “nuisance”.)
This was back in the 90s so they probably weren't thinking about it, but I'm sure there are some grainy digital photos of me somewhere they'd use.
As for the how many of them: We performed at their Christmas Extravaganza or whatever, and there were probably 200 kids in the chorus. We only performed twice on one day, but since it runs every day for three months, that's a lot of kids they got to sign the contract.

I get that Hulk had a case, but he couldn’t have afforded to bring it himself. So Peter Thiel, who has endless money and an axe to grind with Gawker for outing him, funded it.
Which is sort of similar here, except that Musk’s axe to grind is because Disney stopped giving Twitter money and is “woke,” so it’s even more petty.
It was more about who is funding the case than whether the case has merit.

I read about a Jewish woman standing on a train platform whose baby was crying from hunger. Her character was fun, but I didn’t think she handled the “deeper” scenes where they tried to fill out her character.
I loved the show, though, and thought she had potential for future seasons. I don’t miss her not being on the show, and knowing she’s a nutjob erases any sympathy I’d have for her getting Mandy’d.
Just a reminder that anyone can sue anyone for any reason, it’s just a question of how long it takes for it to get thrown out.
I could sue you for defamation, despite neither a conspicuous lack of any contact or reason for it, and as long as I get that news to the Media before a Judge tells me to fuck off and my lawyer gets censured into dust, the headline would still say I was suing you.

Disney doesn’t want to ‘cancel’ her, they just don’t want to be associated with her.
They don’t care whom she reaches as long as people don’t think they endorse her views.
She cancelled herself by playing alt-right culture warrior games. In the real adult world, you have to do what your boss and contract say or else you get fired.
Disney obviously did not run their message announcing Carano’s dismissal through HR, and it will cost them. Carano probably has a good case for defamation because of the way she was dismissed. This was very careless on Disney’s part and has left them open to retaliation. They could have simply announced the departure and left it at that. Future employers should take note that if you dismiss someone, say as little about it as possible.
Not a Lawyer and definitely someone that would love to see Disney get bent over the legal barrel and financial bitch slapped… But Carano has no case and nothing to gain here except publicity with right leaning organizations. Disney gave her numerous chances to walk her comments back and try to educate her to what she did wrong. She refused each time. Disney then terminated her employment and made a standard PR announcement as to why they made the decision they did, something fairly common in the industry.
Defamation would require Disney made untrue comments or statements about her, and her to prove those statements were false or misleading. Since this all happened over public social media, there isn’t any evidence Disney did anything but state facts and amicably as they could inform the public why she would not reprise the character in the future. If there is any comments that would qualify as defamatory Im not aware of any of them.
Hate speech or fascist speech has to be repressed. There should be legal recourse but we are seeing now how the unfiltered and amplifying of profitable “polarizing” messages help fascism spread. It’s almost too late.
PS: But maybe they could bring her back as a storm trooper?
And the first amendment is why we have to push that shit down. The government won’t do it for us! You are not only free to reject, condemn, and punish fascism, you are morally and practically required to.
