  1. Trump will be arraigned on criminal charges at a federal courthouse in Miami today

The indictment is devastating and detailed

But all day you'll hear from pundits and politicians making outrageous claims on Trump's behalf

This thread is YOUR GUIDE TO ALL THE NONSENSE

🧵

Empiricism_Reloaded,

@juddlegum

Generally, Trump & Co gaslight their own followers by accusing others of corruption (when they're the general corrupting influence).

For example, Trump accusing others of being a danger to democracy, when Trump has financial backers from fascists that want to break democracy.

  1. The most common argument is that HILLARY CLINTON did the same thing as Secretary of State when she discussed classified information on a private email server.

Clinton should not have used a private email server, but the situation was VERY different

truthat,

@juddlegum

That screenshot of Hillary looking overjoyed while the chyron describes trump's legal woes is ::chef's kiss::

MoiraEve,
@MoiraEve@mastodon.world avatar

@juddlegum Clinton also 100% cooperated w/ investigation. trump lied, played cat-and-mouse w/ documents, hid them from his lawyers AND the FBI--for MONTHS.

juddlegum,
@juddlegum@journa.host avatar
  1. Trump defenders like the WSJ editorial board note that former FBI Director James Comey said that "no reasonable prosecutor would bring such a case” against Clinton.

But they leave out WHY Comey said prosectors wouldn't bring a case

https://popular.info/p/your-guide-to-the-nonsense-about

juddlegum,
@juddlegum@journa.host avatar
  1. In order to secure a conviction under the Espionage Act prosecutors need to prove the mishandling of national defense info was WILLFUL

So the cases brought involved "clearly intentional and willful mishandling" OR "efforts to obstruct justice," Comey said

juddlegum,
@juddlegum@journa.host avatar
  1. In Trump's case there is literally an audio tape where he admits he knows a document is classified national defense information and shows it to people with no security clearances anyway

That's willful and intentional

juddlegum,
@juddlegum@journa.host avatar
  1. Further, the indictment is full of evidence Trump purposely obstructed efforts to recover the documents, including:

  2. Suggesting his attorney lie to the FBI

  3. Directing his assistant to move boxes of classified info

  4. Suggesting his attorney hide or destroy documents

Phiend,
@Phiend@twit.social avatar

@juddlegum lock him up!

juddlegum,

  1. In contrast, when the FBI requested work-related emails from Clinton's personal server, Clinton, through her attorneys, produced them.

Trump's defenders frequently cite the 30,000 emails Clinton's attorneys determined were not work-related and later deleted.

juddlegum,
@juddlegum@journa.host avatar
  1. But the FBI checked to see if relevant materials were intentionally withheld by reviewing the email accounts of the gov't officials Clinton corresponded with.

The FBI found no evidence that any "work-related e-mails were intentionally deleted in an effort to conceal them."

juddlegum,
@juddlegum@journa.host avatar
  1. The Wall Street Journal editorial board also complained that "Biden had old classified files stored in his Delaware garage next to his sports car."

This complaint ignores the fact that Biden is also under investigation for this behavior by a separate special counsel

juddlegum,
@juddlegum@journa.host avatar
  1. But, like Clinton, Biden is unlikely to be charged because he has been cooperative. The investigation began not because of any request but because Biden voluntarily reported that classified documents were found at Biden's UPenn office.

https://popular.info/p/your-guide-to-the-nonsense-about

juddlegum,
@juddlegum@journa.host avatar
  1. The case was dismissed

The line frequently cited by right-wing media is: "The Presidential Records Act does not confer any mandatory or even discretionary authority on the Archivist to classify records. Under the statute, this responsibility is left solely to the President"

juddlegum,
@juddlegum@journa.host avatar
  1. But the case against Trump does not involve determining whether the documents at issue are personal records that Trump can retain or a presidential record that should be in possession of the Archivist.

https://popular.info/p/your-guide-to-the-nonsense-about

juddlegum,
@juddlegum@journa.host avatar
  1. Under the Espionage Act, the issue is Trump shared NATIONAL DEFENSE INFORMATION with unauthorized persons and failed to return the documents containing the information to government officials.
juddlegum,
@juddlegum@journa.host avatar
  1. Trump's defenders sometimes acknowledge that Trump probably broke the law by indicting him would set a DANGEROUS PRECEDENT.

BIDEN AND HIS FAMILY WILL BE NEXT, they warn

juddlegum,
@juddlegum@journa.host avatar
  1. Either decision made by special counsel Jack Smith would set a precedent. Declining to prosecute, even after uncovering substantial evidence that Trump committed crimes, would set the precedent that a former president is exempt from federal criminal laws after leaving office.
juddlegum,
@juddlegum@journa.host avatar
  1. That exemption would extend to the laws in place to protect national defense information.

Prosecuting Trump sets the precedent that former presidents can be prosecuted.

Which is more dangerous?

That's kinda the opposite of the person who runs (as a kind of co-op) the masto instance on which I'm reading this.

That was super confusing.

illyana,

@juddlegum Hillary's private email server was private because there were no public, secure options at the time (early 2000s) and it was set up by the secret service. It's always been a red herring.

AnecdotallyExtant,

@juddlegum

> The guy who owns this site is infatuated with right-wing propaganda

You made 17 posts that all seemed well researched. Then you made it clear that you don't even know which website you're on and you're just trying to drive traffic to your own site.

And you lost your credibility.

ngmcclernan,

@juddlegum - did you just trash journa.host?

@juddlegum You really really need to stop talking about "this site" when you're on Twitter. Refer to it as Twitter. You're cross-posting to Mastodon.

Maybe you should change your usual last post to, "PLEASE do not rely on Twitter ..." It causes some confusion when you write "this site" when crossposting to journa.host.

Lunatech,

@juddlegum Jusy my opinion but you really need to get on an instance that will let you post all your thoughts in one post instead of breaking your thoughts into chunks of 500 characters or less. Your multi-part post today came in almost completely random order, with parts missing and interspaced with other posts. I could not have followed it all unless I copied every post to a text editor and then rearranged them in order, assuming I could even find all the pieces.

Just FYI, infosec.exchange (the instance I am currently using) allows posts of up to 11,000 characters. But there are other instances that allow long posts as well.

@juddlegum “if they can do this to him, they can do it to anybody!” Yeah that’s kinda the point of this idea of “nobody is above the law.”

And let’s just, for now, ignore the fact that, if trump hadn’t been president and wasn’t the presumptive Republican nominee, he’d have been prosecuted for this (and probably J6) much, much quicker than he has been.

  1. A New York Post op-ed suggests that Trump's best defense might be Bill Clinton's sock drawer.

Clinton's dresser was the subject of a 13-year-old case filed by Judicial Watch which sought access to 79 audio tapes of Clinton interviews conducted by historian Taylor Branch

servelan,

MoiraEve,

Catawu,
@Catawu@mastodon.social avatar

@juddlegum She never discussed classified info on her server. As SoS she used Cables. People don’t know wha those are so they default to ‘email’. She could not send nor receive cables on her server.

Every SoS used a off site servers. Hers was secured. Powell used Gmail and destroyed every part of his account. She preserved everything.

jonahstein,

@juddlegum No one wants to focus on the private mail server detail because that would implicate the Bush White House, the Trump White House and the entire GOP.
