To recap: Supreme Court justices nominated by a president who lost the popular vote and confirmed by Senators representing far less than half the country have eliminated abortion rights, green-lighted anti-LGBTQ discrimination, and ended affirmative action.

In one year.

I donโ€™t know who needs to hear this but, without affirmative action, Harvard is neither race-blind nor a meritocracy

juddlegum,
@juddlegum@journa.host avatar

IMO, we should probably focus less on who gets into Harvard, which is not that important, and more on supporting the educational institutions where most racial minorities and children of working families enroll

This is important as it completely undercuts the claim of the IRS whistleblower, who says Weiss wanted to charge Hunter in DC but was blocked by Graves

RT @ChadPergram

  1. From colleague David Spunt. Spokesperson for DC US Atty Matthew Graves on Hunter Biden case: "As the Attorney General has said, U.S. Attorney Weiss was given full authority to bring charges in any jurisdiction he deemed appropriate."

  1. The Supreme Court decision in Moore v. Harper yesterday, rejecting the independent state legislature theory, was very good news.

But it wasn't ALL good news.

Roberts' majority opinion includes a caveat

  1. Writing for six Justices, Roberts rejected the independent state legislature theory, which the Supreme Court has rejected for 100 years.

"The Elections Clause does not insulate state legislatures from the ordinary exercise of state judicial review."

  1. Roberts ruling, however, comes with a potentially significant caveat.

He says while state courts can review actions of the legislature on election issues, federal courts can overrule state courts if they "transgress the ordinary bounds of judicial review"

juddlegum,
@juddlegum@journa.host avatar
  1. WTF does that mean? Well, Roberts is essentially establishing a concurrence in Bush v. Gore as precedent

In that case, 3 justices wrote that the Florida Supreme Court's order to recount certain ballots exceeded "ordinary statutory interpretation" and was invalid.

juddlegum,
@juddlegum@journa.host avatar
  1. All of this is very poorly defined and the standards for "ordinary" judicial review and statutory interpretation are unclear.

But Roberts decision opens the door for the Supreme Court to intervene in controversial election issues whenever it wants.

Which is not great.

juddlegum,
@juddlegum@journa.host avatar
  1. It's unlikely that the three liberal justices who signed onto Roberts' majority opinion wished to endorse a controversial aspect of Bush v. Gore. But it was the price for avoiding a more extreme outcome.

  1. According to @GovRonDeSantis, textbook publishers are trying to indoctrinate students by incorporating "woke" concepts into social studies textbooks

But DeSantis has provided few details

So we've obtained Florida's reviews of the textbooks

@GovRonDeSantis 5. This is the entire "discussion of lesbianism" within the textbook:

"LGBTQ candidates have also made some headway gaining governmental positions. Tammy Baldwin of Wisconsin became the first lesbian elected to the Senate in 2012"

juddlegum,
@juddlegum@journa.host avatar

@GovRonDeSantis 6. The same review concludes that the "reference of LGBTQ court cases" is an example of "liberal bias" that is inconsistent with state standards.

This is the only LGBTQ-related court case referenced in the textbook:

juddlegum,
@juddlegum@journa.host avatar

@GovRonDeSantis 7. The review of Civics Alive! Foundations and Functions also claims the discussion of "abortion rights" is "inappropriate." This is how the textbook addresses abortion rights.

juddlegum,
@juddlegum@journa.host avatar

@GovRonDeSantis 8. One middle school social studies textbook, Florida US History Advanced, was not rejected by the state but did have several issues flagged by a reviewer.

The reviewer writes that "Slavery image on pg. 444 may violate the statute relating to guilt of future generations."

juddlegum,
@juddlegum@journa.host avatar

@GovRonDeSantis 9. The same reviewer also cites another image that depicts "the life of White plantation owners," which the reviewer believes is "outside the scope of the standard and potentially the law."
