Health insurance giant Medibank is facing a fine in the trillions of dollars, after the Australian Information Commissioner filed proceedings in the Federal Court over its 2022 cyber attack.

UniSuper member Dr Christopher Standen has, through the Environmental Defenders Office (EDO), lodged a complaint with the Australian Securities and Investments Commission (ASIC).

Two of the funds that UniSuper markets as “sustainable” have significant investments in the Transurban Group, one of the world’s largest toll road operators.

“Transurban Group’s business model relies on increasing road traffic, which increases climate and other pollution,” Dr Standen said.

It’s one thing to seek defamation damages if you are declared innocent or not guilty; different if proceedings shut down on a technicality.
Civil proceedings are based on a ‘balance of probabilities’ and not ‘without reasonable doubt’

Lehrmann should have been satisfied that he has his liberty. The heavier onus of proof in criminal proceedings exists because the judgment may take a person’s liberty. That’s not the case in civil cases.

Vatican as State or Vatican as Organisation:

I don’t not support the attention placed on scrutinising the question of ‘Statehood’ and Pope as ‘Head of State.
The precedence this would set against Nation-states in a more precarious position of statehood would make the legal question serious irresponsible. There’s also, the question of jurisdiction in such a claim. Australia would have no means of binding the ruling without taking it to the International court.

What I would support is that it is not The Vatican as state and The Pope as Head of State that is being put on trial.
Rather it is The Vatican as a non-government/not-for-profit religious organisation, and The Pope as head of the organisation, an organisation which is binded to Australian Laws by establishing branches of business within the Australian states.
