That thing last month where the LAPD had their lawyers send a bogus DMCA takedown request to some people selling "Fuck the LAPD" t-shirts, and the t-shirt people's lawyer sent back a letter that literally just said, "LOL, no"? Well, here comes act 2: the "LOL, no" lawyers have sent a 🔥scathing🔥 letter to the other lawyers asking why they shouldn't seek attorney's fees.

I got my first #DMCA notice from my ISP that didn't have any information about the infringing content at all. I know this was from using a streaming site (my lil home server is down) over https, so all they know is that i connected to the domain.

this is what i would call "a bluff" and "not compliant with 17 USC § 512(c)(3)(A)" (a domain is not a single online site)

New York Times files copyright takedown requests against Wordle clones, including games that use includes its “5x6 grid” and “green tiles to indicate correct guesses.”

Created in 2021 by Welsh engineer Josh Wardle as a gift for his wife, it was later sold to The New York Times for $1 million.

Players can play through a subscription to the times or the game itself for a $50 annual subscription fee.

The Times filed at least three DMCA takedown requests with coders who have made clones of Wordle on GitHub. These include two in January and, crucially, a new DMCA filed this week against Chase Wackerfuss, the coder of a repository called “Reactle,” which cloned Wordle in React JS (JavaScript). (The full takedown is embedded at the bottom of this article.)

The most recent takedown request is critical because it not only goes after Reactle but anyone who has forked Reactle to create a different spinoff game; an archive of the Reactle code repository shows that it was forked 1,900 times to create a diverse set of games and spinoffs. These include Wordle clones in dozens of languages, crossword versions of Wordle, emoji and bird versions of world, poker and AI spinoffs, etc."

A volte mi chiedo se ci siano o ci fanno... A prescindere dalla causa ridicola, dato che l'emulatore non fornisce firmware né nessun genere di codice protetto da copyright, ma: "confisca e distruzione dei dischi rigidi degli sviluppatori in modo tale da assicurare la distruzione dell’emulatore;" dimostra una totale ignoranza di come funziona il software libero. Magari vinceranno, perché #DMCA è una forma di bullismo legalizzato, ma eticamente fanno schifo.

@danneidle sorry to hear you are having problems with this. it's not new, it's been around for two decades now. the problem is that the law is completely biased in favour of those who even claim to be #copyright owners. I wrote about it in my book Walled Culture (free download - https://walledculture.org/the-book/) back in 2022. copyright needs to be radically reformed. #dmca

I just realized that PS1 and PS2 game discs didn't have any DRM. You can easily create ISO files using image burning software like Brasero or k3b (for Linux).

I am definitely going to start collecting them again and emulate the games I couldn't play back in the day.

Since I am not circumventing any DRM and I also own the game discs, I am probably still compliant with the DMCA and it shouldn't technically be considered "piracy" either.

I wonder if any lawyers can confirm the validity of this. If true, this would probably make PlayStation and PlayStation 2 emulation totally acceptable.

Basically, an Uzbekistan TV channel used part of a film by Blender Studio. Another artist also embedded part of that same film (both legal under CC license).

The TV company's rant-a-scam "copyright protection" agency semi-automatically reports the artist's video to YouTube as illegal copy of its TV content, despite holding no copyright to do so, and wins. The artist had to risk a channel strike to appeal - and still lost.

YouTube DMCA nonsense did it again. They got a takedown notice for the OBVIOUSLY parody channel There I Ruined It and that channel is now basically defunct. Parody is protected by fair use, but who are we kidding here.

is a terrible law, and it incentivizes media platforms to just obey whoever has more money. It unfairly favors incumbents, and renders fair-use arguments moot as platforms like YouTube have zero incentives to rule in favor of indie creators.
