@GottaLaff sounds like public messaging maneuver more than a legal one. This BS gets shot down by the judge and then Trump publicly whines that the judge is biased because he won’t listen to Trump saying he got bad advice.

To me it sounds like “I got bad advice from my lawyer that caused me to do illegal stuff, but I’m not going to tell you what that advice was.” Which seems an awful lot like “I hear voices…

You don’t need to be an expert. This is most definitely BS. Expect a government motion in limine prohibiting this that they will win.

Either you make the defense and waive privilege or you don’t and don’t. You don’t get to pick the parts you like and reject the parts you don’t.

It’s just so profoundly absurd. You can’t say, “I relied on the good faith advice of counsel” and prohibit the other side from exploring whether the advice was sought in good faith and with apprising the lawyer of all relevant circumstances. Because without those things, it doesn’t negate mens rea.

It’s what Trump loves best, manufacturing innocence by fiat. The. Law. Doesn’t. Work. Like. That.
