You know that corrected bond #Trump has filed today? Well, Tish James’s team has now made a filing of their own, asking, under a NY law, for a justification of the surety. What does that mean? #legal

@Wileymiller @GottaLaff There are two kinds of bonds. One is a cash bond where the person posting must secure by posting the whole amount (cash or assets...like a deed). The other is a surety bond where the company posting the bond guarantees the payment. Bail bondsmen, for example are sureties. Think about the reality TV show...that guy is hunting fugitives because he doesn't want to pay the amount of the surety. The posting co. just needs sufficient assets to cover bond.

@fulanigirl@blacktwitter.io avatar

@Wileymiller @GottaLaff So..Trump was dragging the bottom trying to get the bond. A company may not understand all the requirements to be a surety because obviously this is not something the company in question does regularly. I don't think they were trying to pull a fast one (with Trump that could have been a possibility!). The new bond filing corrects the deficiencies. I think they just didn't know what they were doing when it was filed.

@Wileymiller @GottaLaff Oh I am sure they have tried, repeatedly. However, a lawyer gets to a point where they must decide to chose the $ or to let the client go. So many of them chose $ and they will soon learn, as so many in that orbit are learning, the reputational loss, loss of licenses, and possibly loss of liberty will not be worth whatever $ they receive.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@CStamp @Wileymiller @GottaLaff Normally you pay the surety a % of the face amount of the bond. But, I think this could be a gamble for the surety company. He is not known to pay bills. So, if he losses the case on appeal, will he try to beat the surety for the $? It's possible.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@NIH_LLAMAS @Wileymiller @GottaLaff Trump owes the full amount of the judgment. The point of the surety is if the losing party who is required to post the bond (Trump et al., ) does not pay, the surety company, in this case. Knight Specialty Ins will be on the hook to NY for $175 million. This is the point of a surety bond.

@fulanigirl I'm white so I'm not going to jump on your recent thread. It's a great and important thread so I boosted it.

You're touching on something very important and urgent. Housing is a at one of the highest crisis levels in American history. This hurts real people.

I hope what I say next is taken as complimentary to your posts: stable housing and food needs is both necessary to political stability AND lack of those things were the conditions Mussolini and Hitler rose to power on.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@philip_cardella As I said with my thought experiment a few weeks back, the dangers of fascism that you all are talking about are already being experienced in marginalized communities. What they want and need is safety, having their neighbors and relatives be able to be housed, to be able to eat, and have their children educated. These are their TODAY survival worries. Politicians need to address those concerns.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@philip_cardella I get that Hitler and Mussolini were able to use those as motivators, but if those conditions were dealt with by the governments prior to their ascendancy, they would have had less fodder to work with. The language of fascism and supremacy in a country that has not experienced war on their home turf is just not effective for the masses.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@philip_cardella Agreed. Although we don't know that we wouldn't have known their names anyway, but rather we would still know them as failures rather than the murders of over 6 million people.
I just need committed folks who know about fascism to understand they must be , in a way, bilingual. They must be able to talk to regular people using a language they can access.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@philip_cardella Yes...this is all covered in International Criminal Law....The historical analysis helps show the progression from victor's justice at the end of WWI to creating the conditions of discontent that helped create WWII. The former colonial powers did not however, learn the lesson of not insisting on victor's justice ...and those kinds of agreements continue to fuel unrest throughout the world today.

This post is for the Black and Brown people who post on Mastodon. Other people can read it but this thread is to open a dialogue with our community specifically. I was traveling in Chicago for most of this week and I had an opportunity to talk to quite a few working class folks during my stay. When traveling I usually try and take the temperature on what is happening in Black communities locally so politics comes up often. 1/5

fulanigirl,
@fulanigirl@blacktwitter.io avatar

Not a single person I talked to mentioned fascism nor the stakes connected with the election. Not a single one of them mentioned reproductive freedom and this included four Black women who I spent several hours with on Tuesday. Here are the topics they mentioned: lack of affordable housing, the city’s unwillingness to address the issues that hit them in their pocket, safety in their communities, and immigration. 2/5

fulanigirl,
@fulanigirl@blacktwitter.io avatar

None of them had a clear understanding of why Biden can’t just issue an Executive Order “like Trump did” and resolve the border crisis. They had no memory or knowledge of previous immigration crises such as the Mariel Boatlift . Two of my cab drivers were green card holders. They resented the perceived “open arms” treatment recent undocumented folks were getting versus the hostility they received on arrival. 3/5

fulanigirl,
@fulanigirl@blacktwitter.io avatar

They were mad about funds that were supposed to address local unhoused needs being diverted to the new influx of immigrants. None of the people I talked to had a clear understanding of what rights and responsibilities Congress had versus the limitations on Presidential action. All this to say, the issues for the mainstream democratic party platform did not address the concerns of their communities and their comments reflected that. 4/5

fulanigirl,
@fulanigirl@blacktwitter.io avatar

I am hoping that those of you who post here about fascism, the “stakes,” and voting will also consider sponsoring some coffee klatchs, some informal discussions in a library, for example, or work with a respected civic organization in Black and Brown communities. You can help dispel misinformation and aid civic education. It may not feel as cathartic. This not a criticism of posting but rather encouragement to do something more grounded. 5/5

@daihard LOL no...Asians get lumped in with Brown cause many are. Comment away.

fulanigirl, (edited )
@fulanigirl@blacktwitter.io avatar

@daihard In Critical Race Theory we examine how American law treated Asians (first Chinese and then Japanese and then the rest) as they entered this country. They were "othered" as you know and much of the anti-Asian sentiment on this country can be traced back in a straight line to that time. Until 1957 there was vigorous debate in the courts whether Asians could become citizens because they weren't "white" in the understanding of race at that time. So yeah...y'all are Brown!

@obeto This will always be the result of targeting non-sympathetic whites. Just like hate crime legislation is often used against people of color when the complainants are white...not the other way around.

The Guardian is doing a series of articles on lost and disturbed burial sites of Africans bought to the Americas. Last year I saw a doc made by a Namibian sister who travels to St Helena and discovers the remains of hundreds of Africans carelessly buried. The doc is making the film fests rounds this year. But the Guardian has also posted it in chapters. It's worth watching. I am NOT a Beyonce fan, never have been. But, I do enjoy country music and have posted cuts on my Friday music selections. Black people and particularly Black women have been a part of country music since country music became a genre. Here are some links if you want to learn more about country music artists who are NOT white.

Tennessee withheld billions of dollars from its one public HBCU, Tennessee State, and then tn house voted to oust its entire board and replace it with the governor's picks. Sounds about white

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@thiswomanswerk When the Supreme Court eliminated race from college admissions and the attacks on DEI ramped up, I said the HBCUs were next. Why? Because white folks are trying to eliminate all education for Black and Brown students, not just integrated schooling.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@thiswomanswerk Yes. There was federal audit of the monies that had been provided to states to give to HBCUs. Not surprisingly, 16 states withheld a total of billions. https://www.npr.org/2023/10/06/1204349544/hbcus-have-been-underfunded-by-12-billion-federal-officials-reveal

Protesting is starting to take a physical and mental toll on me.

I really hate that that's the truth right now.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@majorlinux It is imperative that activists recognize their work is extremely taxing. If you burn out or become mentally unbalanced due to the stress and PTSD whatever movements you support will lose you as a productive member. You must take breaks to recharge your spirit and your energy. A break can be a day focusing on self, or doing something that brings joy.

I had to log back in and share this ridiculous 'magical negro" story. Apparently in some dark fragment of the internet, the young Black mayor of Baltimore is being blamed for the bridge collapse. Apparently he was capable of driving the ship AND also building the bridge. Quite a feat since the bridge was built before he was born. I asked the DEI guests if they were responsible for the Boeing air plug but they denied responsibility! Magical negroes are scary.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@gdinwiddie Well...lowering standards through DEI gives them extra magical powers. We'll just ignore the part about the ship's company didn't allow the whistleblowers to make safety complaints. I'm sure DEI caused that too! I'm Black but I swear I need some of those magical negro powers. Life would be so much easier.

@blackmastodon The second part of the ThoughtExperiement asked you all to assume Trump was a distraction and to indicate what you thought the underlying root complaint is for the MAGAs. I asked Europeans not to reply, because their underlying causes of right wing discontent are different from ours AND because they are more willing to critically look at systems than Americans are. I wanted to hear from the people who live here. 1/7
