May is Jewish American Heritage Month — as we celebrate the contributions of Jewish Americans, we should reiterate our commitment to the safety and inclusion of Jewish communities in NE Ohio and nationwide. We must be resolute in saying antisemitism has no place in this country.

    @dangillmor I couldn't believe it when they decided to use his charging system. He had already demonstrated he was an erratic, drug dependent person for over a year at that point!

    @fulanigirl@blacktwitter.io avatar

    @markmevans @dangillmor Yes I've been following the saga in Ars Technica. Although we're seeing comments that in some places up to 1/2 of the charging stations are not working. The question in my mind is can they rely on him (especially now w/o the team) to 1) finish the build out and 2) keep them up and running. He's so unpredictable...it seems worrisome.

    @fulanigirl@blacktwitter.io avatar

    @elpolacodesplegado @dangillmor Sorry that does not make sense to me. Capitalism is an economic system not a culture. If correct planning was done instead of just paying attention to maximizing profits there would be far less mitigation to do later.

    , , # BlackMastodon Those of you who have followed me for a while know I mostly post about the issue of abolition, information about webinars on community issues, and black cultural music and events. I comment on policing but don’t usually post on it. However, the university protests provide an excellent opportunity to highlight why abolition is needed in this country. 1/7

    fulanigirl,
    @fulanigirl@blacktwitter.io avatar

    , , # BlackMastodon The movement in support of abolition has been in process for decades although most people only learned about it when “Defund the Police” was chanted during the 2020 protests against police murders of black people. White folks (and Obama) threw their hands up in horrow at the notion of getting rid of the police. A video reminder of what defund means: https://www.vox.com/2020/6/26/21303849/what-defund-the-police-really-means

    @fulanigirl@blacktwitter.io avatar

    , , # BlackMastodon While many whites were empathetic to cries to halt police killings of innocent people of color, their overall acceptance of the idea that police are a good thing for their communities did not change. You can use a free tool called the internet to look up some of those studies. Communities of color will always be the canary in the coal mine on the issue of militarization of the police. 3/7

    fulanigirl,
    @fulanigirl@blacktwitter.io avatar

    , , # BlackMastodon When we say the police are militarized and don’t create safety, but come with their own levels of violence, many liberals will think, “not in our communities. For us they provide safety.” But that’s the thing, authoritarians NEVER stop with the people who are low hanging fruit. They get emboldened by going after the low hanging fruit when there are no sanctions. 4/7

    fulanigirl,
    @fulanigirl@blacktwitter.io avatar

    , , # BlackMastodon On campus after campus, the long valued tradition of freedom of white speech has come into stark confrontation with the militarization of law enforcement. You can see that the police do not come for “safety.” They came for and with violence. Under what circumstances would it have been appropriate to put police snipers on the roof of a college campus where students are demonstrating? What safety would that have provided? 5/7

    fulanigirl, (edited )
    @fulanigirl@blacktwitter.io avatar

    , , # BlackMastodon The police don’t even respond like that when there is a mass shooter on campus. It’s interesting listening to the white parents and the white residents of the neighborhood surrounding Columbia. The police have them under siege and they don’t like it. They don’t want their children in a sniper’s cross hairs. Well...welcome to the experiences of black and brown communities throughout the country. 6/7

    fulanigirl,
    @fulanigirl@blacktwitter.io avatar

    , , # BlackMastodon Now you know, the police will kill your kids too! They don’t care about your kids. Our nation is addicted to policing. It is costing us lives and unbelievable billions of dollars that could be used to make our communities more stable (housing, education, healthcare) and therefore more safe. If you didn’t understand why abolitionists call for reducing and eliminating police where possible, maybe you can see now. 7/7

    @fulanigirl@blacktwitter.io avatar

    @Mary625 It is unconscionable but what you saw is what all police departments aspire to be. They cannot be reformed.

    @chriswho Unfortunately doing the right thing has never been enough. As humans we haven't really developed that far sadly. But please do fight, do work together, pay attention to your municipal and state budgets. Fight so no white kid has to be hungry or sick or gunned down at school by a police sniper. If you do that ALL kids will benefit.

    I was accused of being argumentative today because I corrected a point of law in someone’s post. There’s very few conversations I get involved with because I get it that sometimes people are just expressing their intense emotions. EX: FASCISM!! But whenever I see a point of law being discussed that is wrong or misleading, I’m going to jump in for a couple of reasons. The offended person can block me, its OK. Short thread 1/5

    fulanigirl,
    @fulanigirl@blacktwitter.io avatar

    One- so few Americans know or understand our legal system I think its important to help with their civic education. Two, we have readers who are not Americans and they may be baffled by how our system works. And finally, to help reduce the possibility of misinformation. Gag orders have come up quite a bit in the Trump cases so I’m going to say something about that. 2/5

    fulanigirl,
    @fulanigirl@blacktwitter.io avatar

    Gag orders although not routinely put in place are not that rare, particularly in high profile cases. Both lawyers and defendants can have their speech restricted. You may recall when the judge in the RICO case when ruling against the defendants request to have Willis removed said he would at some point consider a motion for a gag against Willis because of the speech she made at the church on MLK Jr. day. So, even lawyers have speech restricted. 3/5

    fulanigirl,
    @fulanigirl@blacktwitter.io avatar

    In some cases like Trump’s, the defendant’s speech is restricted and violations can lead to fines and possibly a short imprisonment as Merchan pointed out. Sometimes despite warning defendants and/or their lawyers will violate the gag order. This will lead to another Order to Show Cause hearing. You’ll see that on Thursday when Merchan returns to the DA’s motion from last week. Repeated violations can lead to incarceration. 4/5

    fulanigirl,
    @fulanigirl@blacktwitter.io avatar

    Repeated violations can help demonstrate that the defendant intends to violate the speech restraints. The violations do not in any way relieve the prosecutor of his burden to prove all of the elements of the crimes in the indictment beyond a reasonable doubt. Nor, are they proof of the guilt or innocence of the defendant in the underlying case. Its not Trump’s case obviously, but you can be guilty of contempt and also not guilty of the crimes you were charged with. 5/5

    fulanigirl,
    @fulanigirl@blacktwitter.io avatar

    @Eddiethebulldog I agree that he may not incarcerate on Thursday because he just gave the warning on Tuesday, and the show cause hearing is about things that happened before the warning. So it should be interesting. I would guess any violations coming after this week could push Merchan closer to "lock him up." Thank you for reading the thread.

    @popcornreel Can we agree now that maybe Merchan wasn't a fail? Also innocent people do violate gag orders because sometimes the orders are unjust and/or illegal. Do you remember when the Panther 21 were on trial in NY. They were all gagged, some actually physically gagged. This is not Trump's case. His gag order was deemed justified and upheld by higher courts, but judges DO unlawfully gag defendants. Continued violations demonstrate contempt of court - only.

    One of the things protesting UF students are being charged with, according to local media reports, is violating FSS 876.12, which makes it a crime for a person over 16yo to wear a "mask, hood, or device" to conceal their identity in a public area.

    I had no idea.

    fulanigirl,
    @fulanigirl@blacktwitter.io avatar

    @sfdb This law was originally enacted to keep the KKK from marching with hoods that covered their faces. They could march and they could wear hoods, but not cover their faces. Look how well that has aged!
