A federal judge has ruled Florida’s ban on gender-affirming care for minors is likely unconstitutional and has issued an injunction halting enforcement of the ban.
"“The defendants note that 98% or more of adolescents treated with GnRH agonists progress to cross-sex hormones,” Hinkle wrote. “That is hardly an indictment of the treatment; it is instead consistent with the view that in 98% or more of the cases, the patient’s gender identity did not align with natal sex, this was accurately determined, and the patient was appropriately treated first with GnRH agonists and later with cross-sex hormones.”

“Gender identity is real,” Hinkle reiterated multiple times in his ruling. He accused the defense of enforcing the legislation for political purposes and eschewing medical consensus, saying in part, “the statute and the rules were an exercise in politics, not good medicine.”
@ciechom the decision has barred the law from being enforced against the named plaintiffs. It does not apply to all minors and in no way gives relief to trans adults that have been unable to access care. It is a good first step and will probably lead to it not being enforced against minors. Im not so clear about adults. I haven’t read the full opinion but I hear it’s fire.
@ciechom (*precedent so almost right.) it is definitely a step in the right direction and a very positive result that will likely help the future cases. However it’s just not a full injunction (like people are stating) and so someone still needs to seek a full injunction otherwise everyone else is still unable to access their gender affirming care.
@georgetakei As much as I want to be happy about this, it doesn't stop the adult HRT ban. The only way to get HRT is through an MD or DO, and you have to fill out a form that literally doesn't exist (a consent form the medical board said they will eventually make, without any kind of indication as to when). This leaves something like 80% of adult trans people in Florida without any means to get their medications.
@georgetakei George, de Santis is trying to be the next president and doing all these evil laws in Florida. Here in Brazil we don't get a lot of feedback of how is this being seen by companies, florida voters and us citzens in general. Do you have a say on that?
@georgetakei meh. the initial ban did what the gov needed and wanted it to do. that was a political signal to supporters, knowing full well it wasn’t lawful.
meanwhile, the crowd that’s celebrating are putting a bit much into a hollow victory over this very real wedge issue.
People need to organize in cities because fascism lives in cities and attacks in cities. Safety cannot be outsourced to judges and politicians because their loyalties can be purchased.
So as Ron DeSantis, signed this in to law, can he be charged with a criminal offence as a result, if nothing else it may disqualify him from running for president in 2024.
