If the supreme court jumps in and overturns the Jan. 6 convictions of 100s of people who attacked the capitol it will be one of the most politically charged actions taken by this court and in a politically charged environment.

There are many laws that might need revision, scrutiny, but they reached out through space and time to grab this hot potato.

It's a joke.

@futurebird If SCOTUS overturns the convictions, Biden and democrats better start investigating personal finances of several justices and perjury during their confirmation hearing. They better put bills to have term limits, and increase SCOTUS to 13 members to match federal appeals court districts. Whoever in democratic party objects, especially Biden, call them out. We need changes to SCOTUS.

There are so many cases the Supreme court could take up... where justice has been clearly perverted, and they didn't ... where the harm was intense and lasting. Where it will happen again. But the court was too august and uninvolved in the day to day political grind to care.

But put some right wingers in prison for committing crimes, with ample evidence and video and they will search and hunt for an excuse to help those people out.

And to gut even the thinnest protections to democracy.

But more than that this ruling would be an enabling signal that election violence is still on the table.

It's a political statement from the court that can only be read "Jan 6 may have gotten out of hand a little, but it was within the realm of normal political discourse"

Because why otherwise would they focus on this obscure technicality? Except to trumpet a political position in favor of future insurrections.

The ruling will bring protestors to NYC courts. It will be their permission.

futurebird,
@futurebird@sauropods.win avatar

Because the message of such a ruling is that the system has the back of those who want to decide elections based on who can throw the largest and most dangerous tantrum.

Electoral college be dammed. Popular vote? pfffft.

We rule because we say so.

@futurebird I think if the court really wants to be a political entity, it should be treated like one. And I think the executive and congressional branches need to reign in their power by taking a long and hard look at Marburry

nowan,
@nowan@mastodon.social avatar

@lampsofgold @futurebird Eliminating judicial review is getting ahead of ourselves, don't you think? We can increase the size of the court, we can tweak the nomination process, or we can even try to address the political dysfunction that's lead to the current court, all without taking an axe to a structural pillar of how our system of government has (more or less) functioned for the last two hundred years. Diminishing the role of the Constitution hardly seems like a win.

Loukas,
@Loukas@mastodon.nu avatar

@lampsofgold @futurebird The SCOTUS seems to have simply become a kind of over-senate, or a House of Lords for the USA.

RogerBW,
@RogerBW@emacs.ch avatar

@Loukas @lampsofgold @futurebird The House of Lords occasionally kicks back some of the really insane stuff. That's why successive governments have tried to "reform" it.

Loukas,
@Loukas@mastodon.nu avatar

@RogerBW @lampsofgold @futurebird UK prime ministers for the last 20 years have mostly just tried to pack in their friends and cronies. I agree that the HoL is - even so - more independent than the SCOTUS, which just seems to be a tiny clique of Federalist Society extremists.

futurebird,
@futurebird@sauropods.win avatar

Like are they seriously trying to make us think they suddenly care about the impact of over-broad prosecution for ... "protestors?" Because they love protestors so much and often look out for them.

Except they don't... just this particular group of remarkably violent ones.

voron,
@voron@mstdn.party avatar

@futurebird so is this particular damn Supreme Court

futurebird,
@futurebird@sauropods.win avatar

@voron

A bad joke that isn't even funny.

GreenSkyOverMe,
@GreenSkyOverMe@ohai.social avatar

@futurebird They are doing what now? 😱 🙀 😱

futurebird,
@futurebird@sauropods.win avatar

@GreenSkyOverMe

Yeah while everyone is watching Trump capering and mugging in NYC that evil little court has been making up new law and trying to stick their fingers in every hot button issue they can.

They have delayed the GA case. I say they did it on purpose.

Now they are trying to let the people who tried to run police officers through with American flags out of prison.

They have all kinds of "reasons" for these actions but please consider the overall effect. That is the real message.

futurebird,
@futurebird@sauropods.win avatar

@GreenSkyOverMe

Clarence won't recuse himself or ever acknowledge that he has been asked to do so and ought to at least defend himself remaining on these cases.

All pretense of impartiality is gone. People talk about "the republican justices" when they aren't supposed to be in parties.

The court is broken beyond repair.

StarkRG,
@StarkRG@myside-yourside.net avatar

@futurebird The Supreme Court isn't legitimate and the fewer people continue to pretend it is, the weaker they are.

futurebird,
@futurebird@sauropods.win avatar

@StarkRG

I agree in abstract. But how do we translate that into action?

IDK if sitting on our butts and hoping that the election fixes everything "and then Biden and slowly appoint new people slowly changing the court..."

IDK if that will work.

It's WILD that they even took this case. Buck wild. They are out of control.

StarkRG,
@StarkRG@myside-yourside.net avatar

@futurebird First we need more people to just acknowledge that a quarter of the Supreme Court was inappropriately appointed and that rampant corruption has been taking place for decades. Equate the supreme court with an elitist social club issuing decrees. Make common responses to any news related to the Supreme Court be scoffs and derision.

Politics in the US is completely broken and I'm not smart enough to see a way to fix it, but I can at least acknowledge that it is, in fact, broken.

@qkslvrwolf@mastodon.social avatar

@futurebird general strike is the only action we could take.

Most folks hate the idea, though.
