News alerts just notified me that I'm included in a request for attorneys fees. Okay, so, back in late 2022, I was hired to serve as an expert/hybrid witness for a fraud class-action against , but when Apple found out, Apple flipped out & got me kicked off. Apple's response now to the motion mentioning me is apparently feigning amnesia & pretending they don't know who I am.

A lot of people who spent the last 10 years telling us that respect for the flag was the most important thing in the world suddenly don’t want us to care about who flies what flags how, I notice.

andrew,
@andrew@esq.social avatar

They failed to mention “the flag” demanding respect was in fact simply whatever one they chose to run up their pole.

That works literally and metaphorically.

Reduced my thoughts on Copilot+ PC, as announced, to a piece for Forbes.

TLDR: Also we should think about compliance with things like subpoenas and how completely can anything ever be deleted with such a system.

The more I think about it, the less this seems like a well thought-out product for pros. Dreamed up by coders that already have had their life’s work sucked up by GPT through .

Absolutely, and I'm guilty on all fronts of that as well - but you can at least attempt to listen to people in different situations about what is important to them vis a vis security and privacy.

The fascism debate rages on: Here is why it matters, what the main contentions are, and why the arguments of the Skeptics are increasingly untethered from what is happening on the Right.

Declaring a "Freedom Summer" in the same breath as laying out what colors are and are not acceptable for illuminating bridges is so stupidly Orwellian it would be cringey in Orwell fan fiction.

Is the pretext we're supposed to assume that had previously been living under the non-freedom yoke of rainbows?

Boosting for #legal and #tech friends. Important and underreported issue.

Black taxpayers were between 2.9 and 4.7 times more likely to be audited by a data-driven audit algorithm. The IRS' response is that they're making tweaks.

This is insufficient.

Answers. Accountability. What happened? How did an algorithm exhibit decidedly human biases?

#lawfedi @law https://esq.social/@andrew/112478649419844060

andrew,
@andrew@esq.social avatar

@CarlG

Not basic at all!

  1. Yep. IRS just said they'll make the necessary adjustments -- nothing more.

  2. The study I based my piece on is here (https://drive.google.com/file/d/1kA7CG3cLq6eWmwBVgTDOIMhxuGZwRJ5O/view). They do both, to a degree, finding the disparity across income and EITC claim status. Always possible there is some other intervening factor, which would be resolved if we got a look at the algorithm for audits. See attached grabs.

I reckon Copilot+ PC is going to be a product that an entire class of professional just simply can't purchase or use for work. Thinking of , , etc.

Surely the "features" will be able to be disabled, but can anyone reasonably trust that?

@law

andrew,
@andrew@esq.social avatar

@_L1vY_

It just seems wildly misguided -- I mean I said "professionals" to be kind of a wide net catchall term, but even think of "creatives" (I'm using quotes because I'm not sure these are discrete categories of profession.)

Do you want your creative work being continually recorded and offloaded to some remote server to be chewed up? I know the functional reality is that is already going on for most, but this would eliminate the last (even purely theoretical) shadow to hide in.

andrew,
@andrew@esq.social avatar

@Abdelkader

You're right, I should have put that differently. What I mean to say is can any professional (I'm a lawyer so my perception of that word is biased in that direction) in good conscience make use of it.

Ship sailed and all that, individuals and firms will gobble it up, no question.

andrew,
@andrew@esq.social avatar

@troed

Absolutely, it just seems entirely deemphasized in the products coming to market. Maybe I'll be proven wrong, but I wouldn't want the theoretical possibility of on-device processing to be a fig leaf to cover the reality of essentially GPT-everywhere.

andrew,
@andrew@esq.social avatar

@alysondecker

It is hard for me to imagine an argument that it is non-violative save for "at this point, it is impossible to get this particular horse back in that particular barn."

andrew,
@andrew@esq.social avatar

@alysondecker

Guh. Feel like there are a lot of gross factors at play there and a focus on privacy may not be chief among them. Sorry to hear.

andrew,
@andrew@esq.social avatar

@alastair

Yeah it would have to be a fully opt-in feature that, frankly, should require something on the level of a format and reinstall.

You should have to leap over so many hurdles before your data is dumped into a prompt somewhere, it’s functionally impossible to do so unawares.
