The Judge presiding over my US Dept. of #Labor Office of Administrative Law Judges CERCLA/Superfund whistleblower case against #Apple just issued an Order granting me permission to Amend my Complaint to propose #RCRA and Clean Air Act retaliation, and additional adverse actions!!!

1. Any proposed amendments must relate to the address noted in the initial August 29, 2021, online complaint at 825 Stewart Drive, Sunnyvale, CA, 94086; 2. Any proposed amendments with respect to alleged adverse actions must relate only to the adverse actions first alleged on August 29, 2021, of harassment/intimidation; suspension; constructive termination; and threat to take any of the above actions, but may also include the subsequent alleged termination of employment as noted in the December 10, 2021, case summary; 3. Any proposed amendments with respect to alleged protected activity must relate only to the protected activity first alleged on August 29, 2021, as detailed in the December 10, 2021, case summary; 4. Any proposed amendments alleging the violation of additional environmental statutes beyond CERCLA must demonstrate the violation of these statutes through facts alleged as governed by the above limitations and as supported by the August 29, 2021, online complaint and December 10, 2021, case summary; and 5. News alerts just notified me that I'm included in a request for attorneys fees. Okay, so, back in late 2022, I was hired to serve as an expert/hybrid witness for a fraud class-action against #Apple, but when Apple found out, Apple flipped out & got me kicked off. Apple's response now to the motion mentioning me is apparently feigning amnesia & pretending they don't know who I am.

I sent Apple the first request for production of documents in the US Dept of Labor case (which already went to discovery).

I asked Apple for some very specific things & now, today, Apple's trying to stop discovery.

Today the Judge ok'd the following claims to go forward: Nuisance, Ultrahazardous activities, Breach of Good Faith & Fair Dealing, Tamney, §§ 98.6, 6310, 17200, & IIED (8 claims)

He also granted me leave to amend: RICOc,d, Bane, Ralph, NIED, § 1102.5, breach of contract (7 more claims)

The Judge dismissed some parts of some of my claims without leave to amend, but the only two claims he dismissed in their entirety without leave to amend were SOX &Dodd Frank

I owe you guys more updates about the Gjovik v #Apple hearing on Thursday, but I've been so overwhelmed with emotion the last couple days; I've been kinda speechless.

I'll probably have to write a blog post about it to properly convey what it feels like to do something impossible like this & actually have it go in your favor.

I'll also share the audio recording when its posted (prob next week). The formal decision is prob 2-3 weeks out still, but I'm feeling good.

I think the hearing today went very well.

Best case scenario was I keep all my claims; worst case was I only keep the 4 claims Apple's not fighting - but sounds like the outcome will be right in the middle ground, which is great news. I'm very happy!

When they're released, I'll share the transcripts & decision!

I've been working on my US Dept of Labor filings for a few days straight now. My back & neck hurts. I got only 2hrs of sleep last night. My eyes are burning.

I have to file at least 6 things tonight because Apple's a motion sadist. & I'm behind because Apple also filed so much crap in the civil case at the same time. But I'm almost there.

Remember that dank abyss of corruption in OSHA where my whistleblower complaints were trapped for over 2 years while OSHA just harassed me more?

Since Dec. 2020, OSHA tossed 25 of 27 now closed whistleblower claims against Boeing.

John Barnett was appealing OSHA's dismissal of his whistleblower complaint when Boeing assassinated him.

Today, Apple filed 4 replies in the civil case (& 3 filings in the US Dept of Labor case). You can read the civil filings below & I'll post the DOL ones later. I haven't read it all yet; but after skimming some of it, it all seemed to have the tone of someone screaming hysterically... so I guess I'm doing well.

Apple's facing a civil RICO charge from me accusing them of tampering with a federal witness / informant / victim.

I complained Apple kept intimidating & threatening me to try to get me to drop my federal charges against them.

To prove their innocence, Apple's lawyers just emailed me and directly asked me to drop my federal charges.

#Apple fired me in a blatant & egregious act of retaliation for reporting real safety issues; yet Apple's so powerful, they were able to avoid putting anything on the record about it with the government for years, even with #NLRB & #DOL charges filed before I was fired.

Then I filed the #RICO lawsuit.
