On Monday, Fifth Circuit Judge James Ho used a case over a university's drag show ban to argue that universities shouldn't be allowed to require recognized student groups to adhere to nondiscrimination policies. First take out of arguments: Everyone but Roberts (& Thomas) appeared to see a problem w Grants Pass’s ordinance, but lots of concerns w implementing/effects of the 9th Circuit rule. Hard to see five votes for Grants Pass, but final outcome could narrow 9th Cir or even dodge.
