Grocery chain Trader Joe’s is joining Elon Musk’s SpaceX in arguing that the National Labor Relations Board, which is prosecuting cases against both companies, is unconstitutional. https://www.bloomberg.com/news/articles/2024-01-26/trader-joe-s-follows-spacex-in-arguing-nlrb-is-unconstitutional

@bruno_j_navarro I love Trader Joe's, but no union busting corporation is getting my business

anubis2814,

@Barbramon1 @bruno_j_navarro Yup, bracing for Aldi to start union busting, that will really hurt my wallet. Luckily my local ACME is unionized

@anubis2814 @bruno_j_navarro I have heard of problems in Germany, but nothing recent in the US. Aldi is a big favorite. I hope they don't go over to the dark side. 😢

anubis2814,

@Barbramon1 @bruno_j_navarro I know that VW tried to start a plant in the south with a union, because that's just what you do in Germany and there was such a backlash from the state government they had to make the union "right to work" hoping Aldi takes the same tack

@bruno_j_navarro I'm willing to bet that their pursuit of happiness through the unbridled exploitation of others also is unconstitutional, as is the use of social media and smartphones. Nothing in the constitution about being allowed to hire or fire people, either.

@bruno_j_navarro if the NLRB is unconstitutional, then the Unions will be unleashed. No NLRB regulations to hold them back....

@joeinwynnewood@mstdn.social avatar

@Jon_Kramer @bruno_j_navarro

I'm pretty sure it doesn't work like that.

Without the NLRB standing up for union labor rights company bosses can and will retaliate against union organizing with impunity.

@Jon_Kramer@mastodon.social avatar

@joeinwynnewood @bruno_j_navarro my grandfather was a union organizer. He carried a big stick. He used it on heads. Funny enough, he married a daughter of Pinkertons...

The NLRB protects companies from unions too... it isn't one sided. Imagine Biden not being able to shut down the rail strike a couple years ago...

@joeinwynnewood@mstdn.social avatar

@Jon_Kramer @bruno_j_navarro

The NLRB had nothing to do with the railroad labor situation.

The NLRB adjudicates labor law disputes. Don't blame the agency for the failings of the law they administer. That's entirely on Congress.

Without the NLRB unions would have to litigate everything in federal court where they would get killed, the courts being stuffed with corporate friendly judges.

@Jon_Kramer @bruno_j_navarro

PS my father was a lifelong union member and served on multiple negotiating teams.

Jon_Kramer,
@Jon_Kramer@mastodon.social avatar

@joeinwynnewood @bruno_j_navarro I think I am not communicating the point well. The NLRB is a aspect of the federal governments' control over negotiations between the unions and corporations. It is a stone in the wall. If that stone is unconstitutional, the WALL is.

Your father worked post NLRA, while my grandfather worked pre NLRA. Union guys, like my grandfather, were what corporations were looking for the national labor relations act to protect them FROM. It was a different world out there

joeinwynnewood,
@joeinwynnewood@mstdn.social avatar

@Jon_Kramer @bruno_j_navarro

The NRLB does not exercise control over negotiations.

It issues legally binding judgements on accusations of NLRA violations.

The attack on the NLRB is another front in the regressive-right elites' war on the administrative state.

The NLRA was an integral part of FDR's New Deal, unarguably pro-labor legislation.

The later Taft–Hartley Act was explicitly anti-labor, passed over Truman's veto.

Declaring NLRB/NLRA unconstitutional is not impossible, but ...

would be a(nother) serious SCOTUS overreach.
