And what will we do about it? Probably whine that a minority Congress should do something about it. Take that Sammy!

Alito Refuses Calls for Recusal in Jan. 6 Cases Over Display of Flags

https://www.nytimes.com/2024/05/29/us/alito-supreme-court-recusal-flag.html

> “My wife is fond of flying flags,” the justice wrote in a letter to members of Congress who had demanded he step down from two cases related to the Jan. 6 attack. “I am not.”

@shoq The lustre of the high court … always a myth. Once the Bushes got in and started cleaning up the neighborhood bullies, putting them in suits, confirming them to judgeships, it was bound to seep through eventually. They are scum.

I read the jury instructions.

With the disclaimer that this is absolutely not a prediction of what the jury will do, not much in the jury instructions change what I had to say here:

https://terikanefield.com/wheres-the-beef-trumps-manhattan-criminal-case-and-some-mind-bending-legal-puzzles/

I wrote about predicate crimes for predicate crimes.

The predicate crime for falsification of business records is
NEW YORK ELECTION LAW § 17-152 PREDICATE.

The jury gets three possible predicate crimes for 17-152.

@Teri_Kanefield I can’t see a good reason to not let them have a written copy of the instructions. Boggling. It could become a game of “telephone” so easily. “tell me how you heard it and I’ll tell you how I heard it x 12 plus alternates.

@Teri_Kanefield I think it’s because the election was the motive, the core issue driving all the other elements.

@Teri_Kanefield It’s how you stay sharp and at the top of your game. It’s also a sign that you sniff out every possible option for your clients. I would hire you if I was accused of running a red light or hired a hit man. It’s people dedicated to their craft that make it work for everyone.

Closing statements in the Trump hush money / business records fraud case look like they'll wrap up this evening. They're on a break now (after 5pm). Long day for the jury.

A peculiarity of NY State criminal courts is that the defense gives their statement, followed by the prosecution, with no rebuttal statements. This is generally a procedural advantage for the prosecution, who gets the last word, with possibly a lot of time having passed since the jury has heard from the defense.

Catawu,
@Catawu@mastodon.social avatar

@mattblaze Do they let you take notes?

Catawu,
@Catawu@mastodon.social avatar

@mattblaze The Defence broke the rules and made a statement that had to be stricken from the record in summation. That was (I think) supposed to make that statement stick to the jurors. However, I think they squandered a chance for their other points (if they had any) to be topmost in the minds of jurors because what the jurors will remember about their summation was the scalding scolding they got from the judge.

shoq, to random
@shoq@mastodon.social avatar

I’m not that confident he’ll be convicted. Anybody else would be. But he’s had a lifetime of paying people off or intimidating them to get his way. I can’t imagine all 12 jurors being immune to whatever tactics he and his goons have applied. And then there’s the appeal. We already know he owns much of that process.

Catawu,
@Catawu@mastodon.social avatar

@shoq If they do that, they will have to either create a standard set of rules for all states, or just one by one, ignore the odd laws from other states. They can’t argue for conformity from one state while letting others differ from one another. They will have to be the law makers (which is what they are trying to be, anyways.)

I have to wonder how many other women Trump has bullied into having sex or outright raped, then terrorized into silence or paid them off to shut up. I’m absolutely certain he has a long history of getting away with these kinds of crimes.

Catawu,
@Catawu@mastodon.social avatar

@shoq @Green_Footballs Most sexual assaults lack hard evidence. Few are done with witnesses at hand. The threats often delay reporting and the sarcastic police victimize the victims all over again. So, figure w/what we KNOW he did to E.Jean, it was neither his first nor last attack on a woman. His credibility is toast. So, he said/She said, weighs differently. I think they should all write books about it and let him try to deny it by the strength of his character alone, given his past record

Today, at a Taco Bell, the MANAGER, stinking of weed, dropped my currency on the floor, then implies I am a scammer because I insisted I gave her $5 bill, and four $1s. It required a manager to get her to get down on her knees to look under the toe-space where she found it. Then she refused to finish the order until I thanked her.

I cannot believe any of us are tolerating CNN having a Trumper like Scott Jennings on regularly. I mean what the fuck? Do we the public have no interest or resolve to object to anything these media behemoths do anymore? We squandered cancel culture long before it was vital to our future.

And now college athletes can be paid. This will work out about as well as:

Helmet law repeal
Attorney advertising
Lotteries
Off track betting
Internet gambling

All things conservatives have spent decades advocating, and which mostly served to degrade modern life.

Catawu,
@Catawu@mastodon.social avatar

@shoq since college coaches make millions… exploiting the talents of athletes, and colleges use them for recruiting, and they seldom get the education and most can’t afford to live on the stipends they are provided, yeah, no easy answer, but it does give them a piece of the pie they’ve been baking for decades. Also, if an athlete is injured in college, their scholarship is cancelled.

Catawu,
@Catawu@mastodon.social avatar

@shoq Agree that it needs to be changed, top to bottom. My response is because people were now claiming that the only people not being paid, while coaches were paid/are paid in the millions of dollars, the athletes, were now getting paid. NOW that the athletes are going to get paid, people who never said a word about it in the past, say it’s being ruined. It’s not “being” ruined. It has always been ruined. By design.

Been thinking about getting some sort of Android tablet to read comics on, but worried my preferred feature set ("rectangular screen" "rectangular means the edges of the displayable area are ninety degree angles. that's not a rectangle" "cheap, like tablets were five years ago back when you could still get tablets with rectangular screens" "preferably not Samsung") might reduce the pool of available devices to zero

The GOP has purged any in their ranks who had integrity, intelligence, compassion, or a desire to actually help people. What is left is the nakedly ambitious, the soul sellers and their enablers who see a path to immunity as they act out all their worst fantasies on other human beings, guaranteed to be celebrated rather than imprisoned. Niki Haley is on board with all of it, and so is her ambition.

Shelter in Place for a bear lifted in Santa Paula.

Catawu,
@Catawu@mastodon.social avatar

@ai6yr Or it’s in your kitchen. My friend came home one day and a Big ass Black Bear (we later learned was drunk) broken into her kitchen through a window in the mudroom, which it broke into through those double pained windows there… and was eating a bag of dog food. She had her rifle (just came in from hunting), fired a shot into the floor (bullet still there), and he ran off…through the same windows. Typically, bears make their way in & another way out of houses.

Catawu,
@Catawu@mastodon.social avatar

@kfcrosby @ai6yr Bears have poor eyesight and stick to their territory in the woods for a reason. Clear cut logging has destroyed dens, territory, including fishing and berries, so that is what moves them into towns. Desperation. If the logging co were fined $5K+ for every bear/town encounter, logging practices would change, & it wouldn’t be a problem. A sow with cubs will attack anyone.

Catawu,
@Catawu@mastodon.social avatar

@ai6yr Yeah, apparently another neighbor was making Cointreau, and he makes it by the cauldron full (gifts it to friends around the holidays). Had about 50 gallons on the go, slow simmer, outdoors…along comes Mr. Bear, can’t believe his luck. He dove in and drank almost the full first cauldron, staggered over, tipped over the 2nd, got it all over himself, same to the third… my friend said he smelled ‘kinda fermenty, fruity, alcoholly’.. it was 6 hrs later when neighbor came home & found results

Catawu,
@Catawu@mastodon.social avatar

@ai6yr So, yeah, he was blammo drunk. It was mid summer so no one expected ‘bears getting drunk in the back yard’. There’s so much fish in the streams, berries and typical forage by then. I guess the wind was blowing the right way. And yes, drunk bears also puke, and worse. “Got him outta the house just in time!” She laughed. It coulda been sooo much worse!
