The Supreme Court turns down Michael Avenatti's appeal of his conviction. He asked the court to consider two questions: https://www.supremecourt.gov/docket/docketfiles/html/public/23-6753.html

QUESTIONS PRESENTED Petitioner, an attorney representing a plaintiff with potential contract and tort claims, was convicted of honest services fraud, in violation of 18 U.S.C. §§ 1343 and 1346, and extortion offenses, in violation of 18 U.S.C. §§ 875(d) and 1951, based on demands that he made during settlement negotiations with a defendant. The questions presented are: 1. Is § 1346 void for vagueness? 2. Can civil litigation conduct―in particular, an attorney’s settlement demand―support federal criminal extortion liability?

First decision is in Coinbase. Jackson writes for the unanimous court, affirming the Ninth Circuit.

Breaking: The Supreme Court reverses a district court's ruling that South Carolina's congressional map contained a racial gerrymander. The 6-3 decision is by Alito, along ideological grounds. Thomas concurred in part. Kagan writes the dissent. https://www.supremecourt.gov/opinions/23pdf/22-807_3e04.pdf

The final decision, also by Alito, is in Brown v. US. The 6-3 decision in an Armed Career Criminal Act application case features a Jackson dissent, joined by Kagan and, in part, Gorsuch. Sotomayor joined the majority. https://www.supremecourt.gov/opinions/23pdf/22-6389_6537.pdf

Sam Alito is a problem.

The real question now is what the court does about it.

If that makes things awkward at the court, so be it. It is more important than that.

Anyway, Alito and his eight SCOTUS colleagues are due to take the bench in less than 12 hours. They are expected to issue opinions in one or more argued cases.
