I spent 5 years writing FAQ pages and "talking people off the ledge" each time there was a collective meltdown.

I stopped doing that because it is never ending.

I keep saying the same things over and over.

In 2021, when people were demanding indictments, I said, "indictments are the start of a long harrowing process."

I explained that trials are harrowing.

Judges make bad decisions.

Juries don't always get it right. A person can be guilty but be acquitted.

I told people to stop thinking that the criminal justice system will solve a political problem.

Eventually, I came to believe that the 10% of people who are "highly engaged" with politics are the least informed.

They will always be in a misinformation-outrage cycle.

Fox news viewers consume hours of news but have no grounding in facts because they follow constructed narratives.

I realized the same thing happens in the MSNBC-left-leaning social media ecosystem.

@Teri_Kanefield No, I'm having a meltdown right now because sensible people told me that SCOTUS would deny cert. I can't remember whether that includes you but I have a nasty suspicion that it did. And it wouldn't have granted cert if the fix wasn't in, that they WILL find that presidents are dictators and Trump was entitled to do whatever he wanted. Disaster for civilisation.

Anyone who tells you "we are running out of time" is using a trick known to fiction writers everywhere.

Yes, I also have a master's in fiction writing 😂 (How do you think I wrote such good appellate briefs?)

It's called the ticking clock device. It creates suspense and keeps readers glued to the screen or turning pages.

    @Teri_Kanefield Dog arguments wrt walks, food, etc. are slightly more winnable than with cats. Archie the Golden wants breakfast promptly at 0800 w/a treat before. Walks are easier since back yard is fenced, avoiding bad weather.

    Lemon cat now recognizes the sound of a pull ring opening what he assumes means it is food for him.

    Both of them are well- loved.

    @Teri_Kanefield Yes, it's a literary device. But we also are in fact running out of time. Or at least the judicial system is. In our system, accountability for criminal activity comes thru the courts. In this case, that accountability has been delayed, possibly denied, because, yeah, we ran out of time.

    @Teri_Kanefield Ouch. I"m sorry if I've hurt your feelings. I'm a political scientist by training and I see the legal system as part of the political system. If it gets corrupted, that's not a legal problem, it's a political problem. And it will ultimately be solved, if at all, by a political solution. That's all I was trying to say.

    Most of them (possibly not you) are MSNBC viewers or follow large social media accounts that focus on politics.

    It gets to be like a chorus.

    In addition to people being on the edge, is any of this related to say, America being a common-law system but lay people expecting it to operate in a civil-law matter?

    Even when sufficiently calmed down, I still have a nagging “the courts don’t seem to be engaging in the reality of the situation here” feeling. That could just be a lot of care in respecting previous precedent and in establishing new precedent?

    I don't think that has anything to do with it. The Court made a decision. All we can do is speculate about why. Eventually we may know why they elected to proceed in this manner.

    Maybe, as a defense lawyer, I am accustomed to courts not doing what I want them to do.

    Like everyone else, I can speculate on why they did this, but refuse.

    My prediction is that they'll nix the idea of immunity.

    That's different from speculating on what happened in a closed meeting.

    @Phreba @Teri_Kanefield anyone who wants to know "what Trump did" has plenty of resources at their disposal. They need not wait until the trial completes.

    Dems should emphasize that Trump's defense isn't "I didn't do it." It's "I can't be held accountable for what I did."

    If Trump believed he had a case, he would be rushing to court to get his name cleared. But he and the Republican party that supports him at doing everything in their power to go slow.

    @Teri_Kanefield People who think that the left and the right are separate but equal are a part of the problem. Study after study after study shows the conservative people react differently and get informed differently than progressive people. Specifically, conservative thinkers form a level of loyalty to information sources that liberal or progressive style thinkers do not. This makes it much easier to monetize and organize conservative thinkers. Please catch up.

    @Teri_Kanefield all of this is true, of course. But it hits different, especially with the Jack Smith Jan 6 criminal case, to see the justice system fail so spectacularly.

    Why? Because of the non-legal-system part of it. we all saw the coup with our own eyes - and eyewitnesses like Liz Cheney and Cassidy Hutchinson and so many others have entire books on it.

    Because the second impeachment made it clear he broke laws and the Jan 6 committee laid it out in such stark clarity thereafter.

    @Teri_Kanefield it's incomprehensible and enraging that it appears he's going to get away with his crime on your nation, four years after it happened. The coup was successful if people can't trust the rule of law to work in a manner that stops a person with the ultimate power in your system from subverting it, and that's what this case is premised on.

    @Teri_Kanefield I wonder why there seems to be no public speculation on how much further T must dissolve mentally before the Rs have to pick another candidate; and before he is simply too far gone into dementia to stand trial. He already can’t remember his wife’s name. He told reporters that “In some states, the law allows a baby to be born from the mother’s womb in the ninth month. This has to change.” (source: Robert Hubbell).
