Law and policy commentary from UK.

I also geek out here about lore and fantasy, which are my real interests, as well as about other cultural stuff.

I am often ironic and not always earnest, and so please don't take some of the things I post at face value.

Any “constitutional” or legal questions about the general election?

Ask below and I will reply if I can.

(I used to do this sort of thing on Twitter and I thought I would give it a go here.)

Another inquiry report, another massive public policy failure revealed

If we had proper parliamentary accountability and ministerial responsibility in real-time, we would not have to keep relying on inquiries to reveal what really happened.

Impossible to predict any jury trial.

But Trump’s defence strategy not hopeless.

By not putting forward a positive account of what happened, he has made it as much a trial of Cohen as of himself. And Cohen is a self-confessed liar and grudge holder.

The prosecution have worked hard - very hard - to corroborate Cohen’s evidence. Will it be enough? If the jury don’t believe Cohen then Trump may get his acquittal, despite the other supporting evidence.

How the Good Friday Agreement checks and balances the UK government

With the disapplication of the Rwanda policy in Northern Ireland, we can see how the 1998 treaty practically limits the power of the UK executive

The Good Friday Agreement fundamentally re-cast our constitutional arrangements.

And the story of Brexit, and now also of the Rwanda policy, is that of our governing party constantly being taken by surprise by this.

This by the chair of the Commons justice committee is important and persuasive on why IPP sentences are wrong in principle and bad in practice.

One telling passage jumped out:

“IPP sentences were introduced in 2003 as a new form of custodial sentence. Designed to appear tough on crime…”

How many stupid law and policy things have been done for that reason.

UK Elections

No idea if Andy Street will win the West Midlands mayoralty, but for the west midlands more generally, the loss of Redditch is significant.

I don’t mind the cold - I prefer cold to heat - and torrential rain is bracing.

But this constant, constant drizzle is so irksome. Neither one thing nor the other. As if the weather is stuck hour-glassing between definite states.

TRUMP’S CASE - A VIEW FROM AN ENGLISH LEGAL PERSPECTIVE

I am not an American lawyer, but here are some thoughts from an English litigation perspective.

Trump is adept at what he calls (or his ghost writer called) ‘the art of the deal’ - that is a transactional approach based on exploiting leverage. It is only transactional to an extent, as he will also not fulfil a promise if that also suits him.

RWANDA BILL

Just a reminder that it is not "unconstitutional" for House of Lords to delay a controversial Bill.

The Parliament Acts make this a feature of our constitution.

The House of Commons can be asked to think again in next parliamentary session. If passed again, then an Act.

In the current circumstances, a year's delay even gives the opportunity for the government to seek a mandate for the Rwanda Bill at the general election.

Rwanda

The Prime Minister must have bullish internal government legal advice saying that all appeals can be easily dealt with within 10-12 weeks, including to court of appeal and supreme court.

Or perhaps he does not.

Perfectly constitutional for the House of Lords to insist that Commons think again.

And, under the Parliament Acts,House of Lords can require Commons to think again in the next parliamentary session.

If MPs still in favour, then Bill becomes law.

Lords cannot veto, only delay.

News media yet again full of threats by governing party politicians to leave the ECHR.

And yet again nothing at all about how this would breach the Good Friday Agreement.
