So McDonald's is giving away free fries for the rest of the year...

... if you use their mobile app

... and agree to the updated terms and conditions

... which say: if you use this app you waive your right to trial in any class action lawsuits against McDonalds."

We live in the lamest dystopia.

The stuff that got edited out of Snow Crash.

"...the collapse of other ways to regulate companies, and the inability to sue for a lot of the things that go on in our lives. Most of your life you have signed contracts saying 'I promise not to sue you, and instead, I will arbitrate if there’s a problem.' What’s left is the stuff that you don’t sign a contract for, the stuff that you buy in the store. So the $5 purchases or the fast-food lunch, there you can still sue."

@doyce Also, giving up one's right to use the legal system of the country you are a citizen of shouldn't be legal.

You shouldn't be able to waive that right.

@doyce

I haven't looked at the app, but I have found that most of these apps want free reign over your phone data. Best to stay away from them if possible.

kkarhan,
@kkarhan@mstdn.social avatar

@doyce The good part is that this shit is so blatantly that they don't even bother with that in .

Not that are a thing anyway, but those ToS are just illegal.

Also instead of book bans we get books as option for the ...

ryanc,

@doyce What, and I cannot emphasise this enough, the fuck‽

@doyce I don't believe this for a second. Snow Crash was edited? Not a chance.

mrcompletely,

@jordinn @doyce I just read up on it. Turns out three junior editors died trying to make the third act of snow crash coherent and no editor has been willing to touch his work since. Explains a lot really

@doyce mmmm, freedom fries

My roommate does not comprehend.

The last time she offered to pick me up something there, I told her, "The only thing I ever want from McDonald's is for it to be ON FIRE."

But I think she still doesn't get it.

dangoodin,

@doyce

Holy crap! Do you have a link to the section of the terms of service that establish this?

doyce,

catsalad,

@dangoodin @doyce Oh wow... Here's a link to the updated ToS
🗃️https://web.archive.org/web/20231028041341/https://www.mcdonalds.com/us/en-us/terms-and-conditions.html#disputes-anchor

Our Terms and Conditions have changed. Please take a moment to review the new McDonald’s Terms and Conditions by clicking on the link. These include a binding arbitration provision and waiver of your right to a trial in court, including your right to a jury trial, as well as updates to the arbitration and dispute resolution process. By continuing to use our website, you are indicating that you have reviewed and agree to these Terms and Conditions including the binding arbitration provision. You are also indicating that you understand that you are agreeing to a legally binding contract and intend to do so.

@catsalad @dangoodin @doyce Arbitration should be outlawed. It's abused. (Same for plea bargains.)

catsalad,

@dangoodin @doyce

How we settle disputes.

You agree that:

8.) no claims shall be arbitrated on a class or representative basis as you and McDonald’s hereby waive the right to assert claims in any class or representative action; arbitration will therefore only decide the individual claims of you and McDonald’s; it is agreed that the arbitrator may not consolidate or join the claims of any other person or party to an arbitration between you and McDonald’s under this provision;

fencepost,

@catsalad @dangoodin @doyce pretty sure "no consolidation or class action" clauses have been weaponized in the past and bitten some companies

catsalad,

@fencepost @dangoodin @doyce

fencepost,

@catsalad @dangoodin @doyce I meant more the kind of stories you find when you search for "thousands of arbitration cases"

The dreaded day has come. Terms & Conditions, Terms of Service and Privacy Policies are now must-reads.

Millions will jump on this "deal". And McDonalds will compensate for this minute loss by sneaking in small price raises on that other stuff they call food.

@doyce Why would I ever need to sue McDonald’s? I’m not going to to spill hot coffee in my lap.
