Trump's #legal team appear to have misinterpreted what #SCOTUS Justice Brett Kavanaugh wrote in a 2009 article to back up their claims that Trump can still cite #PresidentialImmunity once he has left office, as the judge—who was nominated to the SCOTUS bench by Trump—was only talking about incumbent presidents.
…In their #WritOfCertiorari asking #SCOTUS to overturn a lower court decision rejecting the #AbsoluteImmunity defense, #Trump's #legal team cited a section from a MN #law review article from #Kavanaugh stating "any President who is concerned about an ongoing #criminal investigation is almost inevitably going to do a worse job as President."
However, in the same article Kavanaugh goes on to state that he does not believe fmr presidents are #immune from prosecution as "no one is above the law"….
#SCOTUS has scheduled argument for April 25 to review #Trump’s claim that he is #immune from #criminal prosecution on charges of trying to overturn the results of the #2020election.
"The #SupremeCourt is not going to find that Donald Trump is #immune from prosecution for crimes committed in office. That’s ridiculous.
"But the Court’s right-wing majority is going to run exactly the same playbook they did in 2020, when they gifted the then-president almost two years of #delay in turning over his financial documents to prosecutors in New York and investigators in Congress.
One way that could happen is if #SCOTUS holds that the president is #immune for some subset of ofcl acts.
But—& this is important—not all holdings that are more protective of the executive branch would require fact-finding. But the Court can potentially address those concerns w/o a remand for (extensive) fact-finding.

At this point, the #legal calendar suggests that if the justices issue a ruling by the end of #SCOTUS’s term in June & find that Trump is not #immune from prosecution, the #trial could still start by late Sept or Oct.
#Trump’s attys filed 7 motions late Thurs aimed at derailing the case, in which he is charged w/ willfully retaining #classified info after he left office & obstructing a federal investigation into his possession of those secrets.
The motions include a contention that he’s #immune from prosecution because he made the decision to send the highly sensitive docs to #MarALago while he was still president.
