Judge Jenkins (who became an NDIL judge in February) sanctions against a plaintiff and its counsel in a case: https://storage.courtlistener.com/recap/gov.uscourts.ilnd.409127/gov.uscourts.ilnd.409127.122.0.pdf

"[W]hile some attorneys seem to approach Schedule A cases in a 'cut-and-paste' style, their professional obligations apply with equal force as in any other litigation."

@kathleenthelaw@mastodon.social avatar

@design_law @CarlG and I wouldn't be surprised AT ALL if the "copied" seemingly identical images used as components are actually stock or public domain images, so the only thing plaintiff could claim would be a very thin argument for the arrangement, which isn't even precisely copied

kathleenthelaw,
@kathleenthelaw@mastodon.social avatar

@design_law Beautiful.
The only thing that would have made it better is if the judge ordered the attorneys to attend a CLE on trademark law

kathleenthelaw,
@kathleenthelaw@mastodon.social avatar

@sqfreak @design_law OMG this guy doesn't just need a CLE, he needs an entire semester long class on IP law

kathleenthelaw,

@design_law @sqfreak Oof. This guy needs a referral to the bar.

Interesting Schedule A order from Judge Seeger: Plaintiff filed for a default judgment seeking $50,000 per defendant. Judge Seeger granted the motion but awarded $1,000 statutory damages per defendant. 😂 Blue Sphere v. Schedule A, 1-22 cv 5599, Dkt. 43 (NDIL Aug. 29, 2023)

@hewittlaw Seeger not impressed one bit

So, I really love @ivory except that I find that, still, quotes are a feature I really need—I don’t like posting things to my follows without explaining why.

@mammoth does QTs, and is nice (recommendations in the alpha build are great!) but very crashy for me (often, among other things, crashing while posting and losing the text).

So: recommendations for clients that do QTs and are Good?

@luis_in_brief @ivory @mammoth

Ditto but for Android (currently on Tusky, but the lack of QT has cut my tooting vs tweeting production by more than half

Oh, now isn't this interesting. While poking around in the Sterne docket, I found this letter from ContextLogic (which hosts the Wish platform).

"Plaintiff has declined to disclose to ContextLogic the identity of the Plaintiff or of the intellectual property allegedly being infringed, even on a confidential basis."

This case also makes me wonder:

What if, from the plaintiffs' perspective, the REAL problem with naming the defendants and stating the the infringement claims publicly is not

alerting the defendants

but

alerting potential defense attorneys?

kathleenthelaw,
@kathleenthelaw@mastodon.social avatar

@design_law certainly possible. There's plenty of firms who monitor federal dockets and cold-email defendants on newly filed cases

If indeed “AI is a lot of work” (and that seems reasonable!) you have to wonder what a wiki-model for AI improvement would look like (both technically and sociologically) https://www.theverge.com/features/23764584/ai-artificial-intelligence-data-notation-labor-scale-surge-remotasks-openai-chatbots

@luis_in_brief OSM/RapID?

kathleenthelaw,
@kathleenthelaw@mastodon.social avatar

@luis_in_brief I assume that edits made using RapID are fed back into its algorithms to improve them, though I have no specific knowledge. There are also other uses of OSM data for training detectors as well.

Bellabooty is back with another case, this time represented by Boies Schiller: https://www.scribd.com/document/658626873/Bellabooty-v-Schedule-A-now-with-Boies-Schiller

This is the first time I recall seeing a BigLaw firm on the plaintiff's side.

(h/t @hewittlaw for noticing the high-powered new counsel)

For some thoughts on the prior Schedule A case I saw from them, see: https://mastodon.social/@design_law/110355390713042808

    Parallel universes are real! You shall be sent to live in one... forever.

    You will get a choice between 5 universes that each have a similar collection of languages though technology & culture may be very, possibly hazardously, different.

    To make your choice you may request one (1) kind of typical artifact. This will be fetched from each universe, you may compare to make your choice.

    Electronics will be disabled. If the artifact doesn't exist... you get nothing.

    What do you request?

    Wrote a furious note to Sens. Murphy and Schatz about their Protecting Kids on Social Media Act, which would require parental consent for <18s to access social media, to tell them they're aiding the GOP's genocidal war on queer & trans kids by cutting them off from the vital lifeline of community, belonging, & inclusion that social media provides.

    Oh, you're worried about youth mental health? All youth, or just the ones whose govt isn't actively trying to kill them?

    Please boost :boost_requested:

    As part of a wave of layoffs, I got laid off from my backend development job last month as the company's financials I was working with have been steadily decreasing. I applied for another job shortly after, and after a month of interviews and an honestly great response from their team, at the last minute, they told me that they were focusing their hiring efforts away from the US and towards Singapore. With Calckey donations, I don't have enough money to pay for rent or groceries. So I'm asking to , I'm the lead developer on the Calckey project, and I'm a fullstack, multi-language developer. I have 3+ years of enterprise experience, and I work great on teams as well as solo. Resume and references available upon request.
