Okay, so I'd like to talk about the etiquette of starting a group email with "Dear Sirs" in the freaking TWENTY-FIRST CENTURY.

My inclination is to delete any emails I get with that greeting.

You haven't even bothered to try to figure out whether I'm a "Sir," "Madam," or "None of the Above"? Or you're assuming that "Sir" is somehow neutral? Miss me with that nonsense.

Or is it just me?

kathleenthelaw,
@kathleenthelaw@mastodon.social avatar

@design_law definitely not just you! Though it is almost always coming from non-English speakers, and in some foreign countries people were taught that way in school and never corrected, so occasionally it's an honest mistake, but also most of the time it's spam

kathleenthelaw,
@kathleenthelaw@mastodon.social avatar

@design_law oh yeah, that absolutely looks like spam, and I wouldn't be surprised if it wasn't intentional, because the plaintiffs want people to ignore it and default, right?

Thanks to @sqfreak for pointing me towards this story about a Florida woman who was caught up in what appears to be a case:

https://www.wfla.com/8-on-your-side/better-call-behnken/pinellas-woman-who-sold-luke-combs-themed-tumblers-owes-country-star-250000-judge-rules/

"[S]he discovered an email in her junk email folder. It was the notice of the lawsuit in October from Comb’s attorney giving her 21 days to respond. She never got that chance and says she was in the hospital when the email was delivered to her junk mail folder and sent to an email address she says she rarely uses."

@design_law @hewittlaw @sqfreak it really should be a violation of the duty of candor to the court to do that

I'm staring at the ports on a USB-C dock and wondering where the world went wrong. Apart from five USB-A jacks (1.5A power), there are six identical-looking jacks. Three are Thunderbolt 4, but one can deliver 98W and the other two only 15W. The other three are labeled “USB-c 3.2 Gen2 (10Gb/s)”—but one front-panel jack delivers either 5V/3A or 9V/2.22A (20W), while the other two are 1.5A (7.5W, implying 5V). Huh?

@nemobis OSM is powered by volunteers (myself included) and donations. If we were taxpayer-funded/staffed, I would fully support all the data being public domain.
(And btw, OSM does partner with government entities to harness volunteer efforts to produce public domain datasets that can be used for OSM and for anything else.)

kathleenthelaw,
@kathleenthelaw@mastodon.social avatar

@nemobis I'm very supportive of wikidata being CC-0, but I'll note that Wikipedia is not. Very similar underlying structural forces at work, with the difference being that database rights law is not a uniform as copyright law globally (and given the mess that is copyright law, that's really saying something)

kathleenthelaw,
@kathleenthelaw@mastodon.social avatar

@nemobis Wikipedia didn't need database rights to keep its volunteer efforts from being exploited by freeloaders while it was trying to establish itself; it had copyright. Try suggesting even now that it switch to CC-BY instead of CC-BY-SA.

kathleenthelaw,
@kathleenthelaw@mastodon.social avatar

@nemobis You've just dismissed my example of OpenStreetMap off-hand, so you're clearly not conversing in good faith.

There's this new type of Schedule A defense shenanigans where someone, somewhere, is convincing defendants to file a boilerplate Answer pro se by the Answer deadline. An Answer that does not raise any important objections or defenses, like personal jurisdiction or improper joinder, or point out when Plaintiff's allegations are objectively false. This is...just great.

So a judge has been assigned in the Geekcommerce case (https://mastodon.social/)

They have posted what appears to be a standard standing order for "cases with multiple defendants": https://storage.courtlistener.com/recap/gov.uscourts.flsd.657245/gov.uscourts.flsd.657245.6.0.pdf

It requires, inter alia, that all "Defendants shall file their responses and motions jointly."

I have no idea how this is supposed to work in a case where there might be hundreds of defendants, many of whom might not even have counsel of record.

kathleenthelaw,
@kathleenthelaw@mastodon.social avatar

@design_law I wonder if that's an indication that this judge is not going to agree to email service of a hundred defendants

The court is holding a hearing on Monday on the plaintiff's motion for a preliminary injunction in the Betty's Best case.

The defendant has filed a "trial brief" setting forth the issues here:

So there's this one firm that seems to always file complaints pseudonymously, using the pseudonym "XYZ Corp." That makes it really difficult to keep track of the various cases. I'm starting to wonder if this is intentional.

If you follow someone who boosts way too often, and you want to see their posts but not their boosts, you can do this:

  1. Go to their profile page
  2. Click on the menu button ︙
  3. Select "Hide boosts from..."

If you change your mind later, go back to their profile and select "Show boosts from..." instead.

kathleenthelaw,

@feditips is there a way to hide boosts of? If I follow someone and they post something that is boosted by several other people I follow, I end up seeing it 4-5 times on the same day. Very tedious. I only want to see it once!

In case anyone is wondering why covid vaccine uptake is so low, it's because it's still super hard to get, especially for families vs individuals.

My local walk-in flu clinic doesn't have it. The next closest one has it, but is 20 min away. But they don't have it for kids. I have to make a special appointment for my daughter. But kids under 5 can't mix and match, so I can't make an appointment until the Moderna shipment arrives (next week?). And I can't get one at the pediatric clinic.

kathleenthelaw,

• Comirnaty = Pfizer-BioNTech COVID-19 Vaccine

• Spikevax = Moderna COVID-19 Vaccine

These are the marketing names for these vaccines.

More info in yesterday’s FDA news release: https://www.fda.gov/news-events/press-announcements/fda-takes-action-updated-mrna-covid-19-vaccines-better-protect-against-currently-circulating
