@heidilifeldman Thank you for sharing this with your highlights. When I was practicing I took a special interest in statutory construction, so I was very interested to see how they dealt with the question of whether the President was an "officer of the United States" within the scope of Section Three. Reading that section of the opinion was very satisfying. The reasoning was not forced or strained and is very persuasive. I wish I had faith that it will stand.

"Put another Rules of Civil Procedure book on the fire."🎶 😂 The first year after we retired, I had way too much fun stoking our Christmas fires with all things legal: evidence codes, civil procedure rule books, and directories of folks I would never need to call again. We did not have many occasions to light a fire in the Keys, but I took advantage of every cold snap to put another useless book on the fire and laugh!

I was telling my niece that I had seen a post last week that made me look for 80s memories, and she said: "Speaking of the 80s, how about that sweatshirt?" When we stopped laughing, I looked down and realized that it was a Christmas sweatshirt that my stepmother (who died 20 years ago) had painted for me. Went to the mirror and found the proof. Made me feel old and nostalgic and happy all at the same time.

@pdiff1 @GottaLaff Probably because they are not evidence; just aids for the lawyers in making their arguments. The jury doesn't get to have what is essentially a written version of the lawyers' argument.

I was unable to post on Instagram this morning because I have a link in my account to mas.to (my mastodon instance). No idea which one of these Meta is accusing mas.to of, but this is why you should not trust Meta or federate with anything they build. If they get to be the largest Mastodon server, then they can start dictating their regressive content moderation policies on the rest of the fediverse. I stand with my admin @trumpet and their decision to preemptively block any Meta instances.

@camhunt Very interesting. I wondered when the news about broke yesterday whether it was related to the notification I got from FB the other day that they had removed a post because it was "spam." I heard from several people who had had posts linking to Mastodon content removed with a similar notification. Way to make nice with the fediverse, Zuck!

Is FB really reaching back to a year old post saying that I "tried to get likes, follows, shares or video views in a misleading way." Really? I am absolutely dumbfounded. Of all of the misleading BS that comes across my FB feed every day, this, THIS is what gets removed? I feel like I'm in the Twilight Zone!

Current situation. 💕 Home with Mama'nem for the holidays. Only this time the baby monitor is in her room, and I am taking care of her. She's actually getting around pretty well, but she just is not ready to give up living at home. So we are taking turns staying with her 24/7 until after the holidays.

I was looking through my saved documents yesterday, looking for something from my lawyer days. It seems that most of what I wrote - so many articles - went with the server when we closed the firm 14 years ago. But I did find this and it made me smile.

My career

Mine was a tiny voice

which helped a tiny group of people
resolve tiny problems.

But I did speak.
I was heard.
I did help.
