    When you hear Republicans calling the trial an “injustice,” or saying that it was a “political prosecution” or that the U.S. is a “banana republic”—

    Remember that 12 ordinary citizens found guilty.

    He was held accountable by a “jury of his peers,” which is how the U.S. justice system is supposed to work.

    ’s sentencing will happen July 11.

    A Bloomberg commentator just said, “Well, he’s a first-time felon…” implying that he might not get a harsh sentence.

    I read the jury instructions.

    With the disclaimer that this is absolutely not a prediction of what the jury will do, not much in the jury instructions change what I had to say here:

    https://terikanefield.com/wheres-the-beef-trumps-manhattan-criminal-case-and-some-mind-bending-legal-puzzles/

    I wrote about predicate crimes for predicate crimes.

    The predicate crime for falsification of business records is
    NEW YORK ELECTION LAW § 17-152 PREDICATE.

    The jury gets three possible predicate crimes for 17-152.

    1/

    kkeller,
    @kkeller@curling.social avatar

    @artemesia @dalfen @Teri_Kanefield what I read elsewhere, and have no idea if accurate, is that the statute of limitations on the misdemeanors has expired, and therefore the jury can only find him guilty of felonies. (I will try to find where I read this.)

    ***** The Meeting *****

    It was an unprecedented meeting. SPECTRE, THRUSH, KAOS, Soylent, Tyrell, Omni, and at least a hundred more -- the list of organizations and firms in attendance seemed nearly endless.

    There was but one topic on the agenda. A proposal by their newest member -- Microsoft -- to embed a super power spy system into every Windows users' PC.

    "We call it Windows Recall. We enable it by default, and every five seconds it takes a screenshot of what the user is doing, and keeps it for months or years!"

    "Won't people use that to copy movies?"

    "Oh no, that we'll block!"

    "Very wise."

    The discussions went on for hours, reviewing the many ways that such a system could be used for evil by various authorities, governments, politicians, ransomware criminals, and many more.

    The time came for the vote.

    To the shock of Microsoft's representative, their plan was voted down unanimously.

    "But why?" he protested. "We thought you of all people would embrace this system!"

    In unison they shook their heads.

    "Sorry, Satya. You're just too evil for us."

    There are MANY videos on explaining the so-called "Monty Hall" paradox, some diving deeply into fairly complicated probability math.

    The paradox is traced back to the very long-running "Let's Make a Deal" game show, hosted for many, many years by Monty Hall.

    The paradox involves the prospect of staying with your choice of one of three doors that might contain the grand prize, or switching to another of the three doors once you're shown that one of the doors you didn't choose doesn't contain the prize.

    While most people assume that staying with their current pick is a reasonable choice, the math says that you should actually (for best results in the long run) switch to the other available door. It's really quite a non-intuitive probability puzzle.

    The irony is that Monty when asked about the paradox consistently insisted that the show never actually offered contestants the choice to switch doors, and that the paradox was actually based on a "what if" postulation not the actual procedure on the show!

    kkeller,
    @kkeller@curling.social avatar

    @lauren @jmorris of course it's on Wikipedia (so it must be true!).

    https://en.wikipedia.org/wiki/Let's_Make_a_Deal

    "Though usually considered joke prizes, traders legally win the zonks.[21] However, after the taping of the show, any trader who had been zonked is offered a consolation prize (currently $100) instead of having to take home the actual zonk."

    lauren, to TikTok
    @lauren@mastodon.laurenweinstein.org avatar

    The TikTok Ban, Joe Biden, and SATAN!

    The ban -- which will likely face years of litigation and may be ultimately turned down by U.S. courts (as it should be) on first amendment and other grounds, reminds me of another dark episode of bipartisan madness decades ago.

    Back in the 1980s in particular, "satanic cult" scares spread across the country, the media, and politicians of both parties. Innumerable lives were ruined as innocent people were imprisoned for long periods based on much the same nonsense as during the Salem Witch Trials of the 17th century. The lack of actual evidence in both cases didn't stop the panic.

    While the TikTok ban shouldn't force innocent people into prison or result in them being burned at the stake, many lives that are dependent on income related to TikTok would be negatively affected, and a popular communications medium for a vast number of Americans would be cut off -- while the lack of actual evidence to support such drastic actions is glaring.

    There is also much hypocrisy in play. Even as President Biden signed the ban, his campaign apparently plans to continue using TikTok! Not a good look Joe. Not good at all. That's the kind of thing we expect from Trump. You're better than that. -L

    kkeller,
    @kkeller@curling.social avatar

    @jonahstein @lauren US residents who are TikTok users also have First Amendment rights.

    If the issue were "national security", Congress could ban TikTok on federal devices and networks.

    If the issue were "misinformation campaigns", Congress could pass bills regulating misinformation on all platforms.

    Thus, the issue seems to be "Congress doesn't like TikTok". That isn't sufficient to cut off US residents from it.

    This article from the EFF seems naive at best. They argue that Tier 1 ISPs should not police speech, which is fair, but their proposed solution is to just let hate sites sit around and radicalize people, then have the law deal with the few who cross the line between protected speech and criminal harassment.

    Below is an extensive list of all the times 'just throw more cops at the problem' has solved anything:

    1. literally not once ever.
