Because this is a civil case, for damages, the finder of fact (the jury) can consider his not testifying adversely against him.

Which means that whatever he would say on the stand would be worse for him than refusing to testify.

Rudy is a weird case.

Like most NYC mayors, the majority of New Yorkers hated him because he was a corrupt piece of shit.

Then 9/11 happened, and national media turned him into a symbol for all of NYC.

Even tho one of the factors that made 9/11 so devastating was he put off relocating the emergency response center for years because he had a mistress in an apartment a few blocks away and he used the center as an albi when he went to see her.

He lucked into nationwide goodwill, and an average politician would have capitalized on it. But Rudy being Rudy, it’s amazing he held onto for so long.
