Someone I know in the #GTA who’s #trans and that is a victim of domestic violence. I need to connect that person to resources that can help her get the person assaulting her out of her life.
Fortunately, she is the only one with a legal right to live at her residence. Unfortunately, the abuser is threatening to escalate things.
Apart from calling the police, what other #DA#DV orgs are in the GTA that I can refer her to?
#Georgia#DA: The number of contacts between #Wade & #FaniWillis don't prove that they were in a relationship; only that they were in contact. Out of the 35 times Wade's handset connected to Hapeville cell towers in 2021, the DA wasn't there at least 8 times. Abbate says that experts commonly testify that these records aren't reliable & that AT&T sometimes has duplicated records.

DA: #TerrenceBradley did not impeach anyone, including #Wade. Any of Bradley's testimony was improper impeachment because it did not confront Wade in any way. Maybe Bradley lied to #AMerchant. Yeartie told her atty she had no info about the relationship.
DA: The standard for DQ requires the defense to show an actual conflict of interest that Willis received a financial benefit.
#Georgia#DA: The burden is on the defense. It is a high standard of proof to prove misconduct to DQ a prosecutor. The defense's cited cases are misleading, inapplicable, or support the State's position.
#McAfee: There are a number of cases that exclusively refer to an appearance of impropriety, though.
DA: My review of the caselaw is in those cases there was also an actual conflict of interest. When you have an actual conflict there will always be an appearance of impropriety.

DA informs court that the cell phone location records were not analyzed by an expert nor were they peer reviewed. The normal practices that are used to check data were not used here.
