HAPPENING NOW: The jury says it wants Merchan to begin the instructions with the part about how they are supposed to consider the evidence and draw inferences -- including the metaphor about how if the ground is wet in the AM, you can infer it rained over night.

@GottaLaff: I don't understand why the jury instructions can't be provided to the jurors like they are in federal trials. It seems like something that they should have for reference rather than being forced to request portions be read to them multiple times throughout their deliberations. If it's a matter of NY state law, that seems like an intentional inefficiency.

Judge Merchan tells the jury that Trump lawyer Todd Blanche's comment was "improper, and you must disregard it."

"If there is a verdict of guilty, it will be up to me to impose a sentence." He adds: A "prison sentence is not required in the event of a guilty verdict."

@GottaLaff: I did read them, and I was trying to find them again this morning, but I couldn't get them to come up. I appreciated how much work you had to do to arrange your move.

I know you were very concerned about what has been happening here since 2016, and that it took you several years work through the process to be able to move toward becoming permanent residents of Canada. I thought you were staying U.S. citizens and would continue to vote as expats, and you'd be safe in your new home if everything went to pieces here, but I wasn't sure if you intended to remain U.S. citizens if and when you had the chance to become Canadian citizens down the line. I thought it would depend on what happened here. After all, if the U.S. does go full fascist theocracy, being a citizen, even as an expat, could be dicey.

@GottaLaff: It also takes years to qualify and become a permanent resident of Canada, assuming you can qualify like you, Mr. Laffy, and the boys have. You are very fortunate to have this option.

Sad indeed that you had to take these steps to remain safe in our increasingly disturbing times, but very glad to have your voice, insights, and visits. Thank you for all you continue to do.

@GottaLaff: Wow. I knew it was complicated, but that's insane.

I looked into what it would take to emigrate to Canada in 2016 after Trump won in case things got bad enough to make it impossible to continue living in the U.S. and discovered that I didn't qualify. I sure hope that the worst doesn't happen going forward here this round, but congrats on your move. It must be a great piece of mind to know that you'll be safe no matter the outcome in the states.

Remember:

There were possible crimes, but tax and reporting crimes are not election interference.

There is also a circular thing with Cohen and Pecker telling the court that they expected Trump to pay back the hush money payments.

If they expected to get paid back, it was a loan to Trump and not a contribution. Right?

@Teri_Kanefield: Adding today's Status Kuo from @jaykuo to your weekend blog post, yes there were crimes committed, and because of NY's specific statutes, previously charged or not, it seems like this could even rise to the level of election interference. Yes, that's attention grabbing, but not inaccurate per NY state election laws.

It will be fascinating to see how this all plays out in any case.

JUST IN: signals it may undermine more common charges as justices ask DOJ to respond to petition challenging 'disorderly or disruptive' charges v. Russell Alford. DC Cir ruled charges valid even for nonviolent protesters.

@GottaLaff: These are such full days. You are doing a great job keeping it all organized and coherent injecting just the right amount of snark and/or levity where appropriate.

It's hard to believe that they may indeed finish jury selection tomorrow. Here's hoping that all of the jurors empaneled so far stay the course and that opening arguments begin on Monday. I'm impressed with Justice Merchan's handling of his courtroom under such difficult circumstances. I wouldn't expect this to get any easier as time goes on.

@GottaLaff: Still a ways to go, but we could get there. That would be such a huge boost to our democracy since it's impossible to pass a Constitutional amendment in today's political climate to eliminate the EC.

@GottaLaff: Yes, frustratingly so. With so much on the line though, just maybe enough states will recognize that the EC no longer functions as it should and hinders democracy in a very tangible way forcing a tyranny of a very gerrymandered minority over the majority.

In other words, there is some hope.

This trial hasn't even started yet, not one witness. Yet...

I'm getting Doomers galore in my feed.

A Trumpy helped convict him in an earlier trial.

The prosecutors are vetting the jurors carefully.

I am not Dooming. Not yet.

Can we wait for the trial to be in full swing before predicting the worst possible outcome? Or do people thrive on constant pessimism? I just don't.

@GottaLaff @TheEjj: I would agree that trial is likely to be problematic if it stays with that judge based on the filings and the rulings so far, but even there, we won't really know until it plays out.

On the upside, the documents case is very well documented, and Jack Smith's team is the best of the best, so I wouldn't write it off yet.
