Smith’s filing represents the most stark and high-stakes confrontation yet between the judge and the prosecutor,
illustrating the extent to which a ruling by Cannon that legitimizes the #PRA as a defense could eviscerate the historic case.
It sets up the possibility that a government appeal of such a ruling could delay the trial well beyond November’s presidential election, in which Trump is the presumptive Republican nominee.
Jeff DiSantis, a spox for the DA’s office, noted in a text message that the case had not been put on hold, adding that prosecutors will “work to move it forward to #trial as quickly as possible.” The DA’s office will only comment on the #appeal in #court filings, he said.

The UPC Court of Appeal has rejected applications by Mathys & Squire LLP and Bristows (Ireland) LLP to intervene in the appeal by Ocado against an order giving access to its statement of claim. The ruling is on basis that the applicants do not have a legal interest in the outcome of the appeal. I think this sets the bar to admissibility of intervention too high, arguably contrary to the whole point of intervening on policy grounds.

#Trump’s #appeal of that order is also proceeding in the US Court of Appeals for the DC Circuit; in the meantime, #Chutkan has put a hold on trial proceedings. #JackSmith… said in his filing to #SCOTUS that the appeal could take months & significantly #delay the start of the #trial.

Winning the appeal is only one of #Trump’s goals in challenging the decision. All along, he & his lawyers have had an alterative strategy: to #delay the #ElectionInterference trial for as long as possible.
If the trial were to be put off until after the #2024election & #Trump were to win, he could have his AG simply dismiss the charges. Holding a trial after the presidential race would also mean that #voters would never hear any of the #evidence that prosecutors have collected about Trump’s expansive efforts to reverse the results of the last election before weighing in on whether to re-elect him.
