#DOJ Can Reopen NAR Antitrust Probe: Appeals Court >>>
The National Association of #Realtors is officially back in the federal spotlight.
The Department of Justice can reopen its #antitrust#investigation into the trade group’s policies, according to a ruling in a Washington D.C. federal #appeals#court on Friday.
TFG Appeals $364 Million and Counting Decision in NY Fraud Case
TFG has appealed his $454 million New York civil fraud judgment, challenging a judge’s finding that Trump lied about his wealth as he grew the real estate empire that launched him to stardom and the presidency.
"Now that #SCOTUS has a #DC#appeals#court opinion that may have a majority of justices onboard, we may hear more on another doctrine that starts with the word, "collateral" this time related to Colorado's ballot ban. It's called "collateral estoppel." If the SCOTUS wants to finally get rid of the fool who thinks he has the power to murder judges, all they have to do is to rule that the Colorado ruling can be used by anyone with standing to knock Trump off of all #2024#ballots under the doctrine of offensive non-mutual collateral estoppel." 😎 -t.h. 浩勤
A #NewYork#appeals court rejected Trump's challenge to a #GagOrder & $15k in fines on Thurs in the high-stakes #civil#fraud case that threatens an estimated $250M in #damages & Trump's ability to do #business in the state.
NY trial Judge Arthur #Engoron imposed the limited speech restrictions after #Trump & his #lawyers repeatedly made disparaging comments about the judge's principal law clerk.
As a consequence, #Engoron canceled the #business#licenses that allow #Trump to operate his companies in #NY…
On Fri, an #appeals court judge, Peter #Moulton, paused that part of Justice Engoron’s order, but refused to stay the #trial itself, as Trump’s attys had requested. While Trump’s control of his companies is still at risk, he will not immediately need to #dissolve the #legal entities he uses to manage #properties. The issue will be argued in front of a panel of appeals court judges. #AD1
The trial is scheduled to last until the end of Dec but is expected to end sooner.
Trump arrived in the courtroom & strode past AG #LetitiaJames, seated in the first row, w/o making eye contact & immediately took a seat at the defense table.
While pool photographers took his picture at the defense table, looking solemn, in camera-ready way, Judge #Engoron looked amused.
A #lawyer for the AG, #AndrewAmer, pointed out what was clear from early on:
#Arguments by Trump’s attys do not seem to have been affected by the judge’s #ruling last week. They are again making arguments that have been rejected, hoping for a better result if & when the case reaches an #appeals court.
Lunch break.
As he left the courtroom, #Trump glared at AG #LetitiaJames as he passed her. He was followed by #EricTrump, who addressed James & shook her hand.
His targets were #James, the #NewYork#AttorneyGeneral, & the #judge overseeing the #trial, Arthur F. #Engoron. #Trump’s #lawsuit argues that they ignored a June #appeals court ruling that excused Trump’s daughter, #Ivanka, from the case & also raised the notion that some of the accusations against him & his company might be too old to go to trial.
#Trump’s #lawsuit —& in turn the fate of #NYAG#James’s case against him— hinges on a passage in the June #appeals court ruling that has become a #legal Rorschach test of sorts, in which each side sees what they want. Trump’s #lawyers are convinced that the June ruling effectively tossed out the claims against him, while James’s team has argued that it had little effect on the accusation at the heart of her case— that Trump overstated his net worth by billions in his annual #financial statements
The #warrant, obtained in Jan, adds a new dimension to the scope of the federal inquiry into #Jan6, 2021.
The court papers, which emerged from an appeal by Twitter challenging the judge’s decision to issue the warrant, did not reveal what prosecutors were looking for….
A federal #court of #appeals upheld that #fine last month in a sealed opinion. On Wed, the court unsealed a redacted version of that #opinion, revealing details of the secret battle for the first time.
